RANT:About to lose truck, suing used car dealer !!

    Yeah - it's reached DEFCON 1. This should be the top of your priority list.


    Despite what others have said, I'm not so sure I'd be so hasty to let the truck out of my possession. The truck is your leverage with the existing lienholder. Once they've got it - they're no longer motivated to be working with you.

    Then you're in the worst of all possible worlds, your money's gone AND your truck is gone.

    It's been ALL DAY man. Have you got those guys on the phone yet??

    You need to be documenting all your contacts with everyone at this point, and that notepad should have NO blank days in it - days where you didn't talk to at least three people on trying to run this into the ground.

    This happens more often than you think. When a dealership is in serious financial trouble, they try to boost revenue (sell lots of cars/trucks at discount) while delaying bill payments (read: paying off liens).

    Your dealer is probably on the verge of being insolvent, and they won't have enough money to cover all the liens out there. You need to be aggressive and make them pay now. You want to be at the front of the line of creditors.

    If you don't do that, you will be stuck with your truck and its lien with no useful recourse.

    Good luck. Getting your money back should be your full-time job for the next week, or forever hold your peace.

    Okay guys. I have been a repo man for about 5 years now. If you take the rims off i can still get it. As long as you have it locked up they cant do much. They will have to take legal actions. In South Carolina it is a claim and Delivery. That can take a few months to work out. If I go to repo a car and the debtor tells me leave and no one with my company to come back we cant. We are unable to cut a lock or move a car that is blocking the truck in. But we repo men (well most) are very skilled at get to the car even if ou try to block it in. I would leave it locked up till you get everything straight. Thats if you lived in SC not sure of the laws in TX

    the tx lawman gave you good advice,, and you can be served a claim and delivery warrant for the truck,,that's wether you keep it in your garage or hidden elsewhere, then you go to court and see the judge,,get your atty on it right away..also i recommend finding out name of orig. lien holder and contacting them, and also your lien holder and advise all of what is going on, give them your atty's name and #,,

    my advice based on 29 1/2 yrs at gmac in collections, repo's included

    id be pissed, there was a dealer in sacramento pulling something similar a while back, almost bought a 97 z71 from them and the title sounded shady so i walked away .... the truck had bad paint too so that didnt help

    Why not sit down with the dealer that sold you the truck and make the necessary phone calls required to get you the title? That way you really know what's going on instead of he said she said. I wouldn't leave the dealers office until it was all straightened out.

    Sorry guys for lack of update on this. Logging on here took a back seat to the troubles I'm going through with the truck. I still have the truck parked in the garage. Been driving my beater Honda for now. I really want to keep the truck or the very least get a full refund to buy another. I since have obtained an attorney that will try to sue to either get the title cleared up asap or for a full refund. The attorney did some research and it looks like the lienholder did not get the rest of the $9000 owed on the truck. The lienholder(bank) is trying to sue the dealership, original owner, and me. Looks like I am the only one that hasn't been served. The other two has been served last month with deadlines to respond last week. My attorney will try to stop the court orders for repo-ing the truck since I have all paperwork that stated I bought the truck for the full amount and not delinquent with my bank. We will sue the dealer for 'deceptive practices'. What a f..kin' mess!! Will update you guys later..Thanks for all the advise.
