I would not wait for the accident report to contact an attorney, when my truck was totalled last August (due to other person pulling out in front of me, sounds very similar to your accident) we had a heck of a time even getting the accident report, the involved police department kept saying it "wasn't ready", our insurance claims person finally got a copy of it from the other driver's insurance company, and she gave us a copy. And the other driver does not need to be cited in order to be determined to be at fault, at least around here the "at fault" driver isn't necessarily always cited. As a matter of fact you may well not even need an attorney, if the other driver is at fault your insurance company should do everything that is necessary to get you your money, for another truck and for medical expenses. Mine (Allstate) did, they treated me well.

Hate seeing a Tacoma looking like that.

Hope your wife recovers fully, glad you and the little one are ok. That's most important, the rest will work out. Best wishes. Get another Tacoma - you know they are good trucks.

    yes.

insurance has picked up my truck and they found 18 thousand in damage without even getting into the engine bay.

    total loss.

i owe 19.5, they want to settle 22.5, but the truck is worth 24,5.
have spoken with my attorney, will be talking more on monday about the claim with geico and the rest of the filings for the lawsuit.
