    If he didn't have lights on then it's his fault. How the fuck do you yield to invisible shit? The problem is gonna be that no one was ticketed as far as insurance goes. I'm betting this will most likely end up being something you pay for in higher insurance costs unless the police report states that the other guy didn't have lights on while dark. If it does say that then why the hell wasn't the cop able to ticket him? Seems like this will come down to his word against yours and respective ins companies will pay for their own insured vehicles and both parties will be paying more and have an incident on your records for however long your state keeps them on there. Sucks. Glad your OK & that it wasn't worse.

    It's 6:52 AM right now in L.A. and you definitely need lights on out here. Problem for you is that there is probably no proof that his lights were not on unless he admitted it. Your best bet would have been to stfu and deny fault when the cop asked for details. If you blamed it on "no headlights" then you will probably be at fault.

    He still pulled out in front of someone that had the right of way, no headlights is his only chance at not being at fault.

    Rare of cops; the bad ones often enjoy making calls when they have no clue, like when a car hits a bike, I've seen this noted: "bike crashed into car's bumper at side angle." Anyway, it would have helped you if they wrote his lights were off, but without that, it's a crapshoot and not in your favor.

    Hey guys, finally got around to get my truck repaired. Came out perfect!

    ps: If you ever want to wreck your shit without it being your fault drive around without your headlights on when its dark out.
