Truck Siezed

    Ok here is my vent for an absolute crap situation. So I bought my truck off of a guy about 4 months ago now. Last night I looked outside to find it hooked up to a tow truck. I ran outside being like what the hell is going on. A lady comes up and gives me a warrant and siezure notice. All I could say was what the @#$%. The money was taken out of my account today for my loan and I have never missed a payment!

    Apparenly the guy that I bought my truck off of has a lien with a debt totaling $34,000. Now they can just take my truck away with no notice, 4 days before I am supposed to go home for christmas. Like what the hell. I have been absolutely screwed out of my truck right now.

    I have managed to contact the guy that I bought the truck off of and he seemed genuinly concerned, and is looking into to it.

    All I cn say is this better be one big misundstanding cause i have no desire to go through civil court.

    wow! that sucks. I don't how they could do that. I guess that is why you're supposed to check for liens on big items.

    I don't Know much about the law. I would get the bill of sale, the title (or if the bank has it a copy). Go to the police and report it stolen. I'd call a lawyer first. That's total BS. Also did the old owner finance the loan for you? If a bank did how can they siez it?

    I believe that a house can technically be bought with a lien. If you don't know about the lien, then you are screwed. Luckily, a few lawyers are usually involved in home sales and they check that sort of thing. I don't know that buying a car could be any different. It looks like you might have spent $20,000 on the truck but to own the truck it could cost you $52,000.

    From what I have been told from the siezure company, basically Toyota Credit blah blah took outn a lein first. Thus my bank has no right to the truck even if I stopped making payment (just looks bad for credit). I was told that in cases like these if it is not resolved then I end up sueing the guy for my 30,000 back and I get no truck.

    According to the guy who I bought it off of, the Toyota dealership that he bought his new truck from (Tundra) is supposed to be paying off that dept....I am not sure how this works. The guy is not bad off as he had a lexus and a Tundra and a 1.5 million dollar house. Thus I am banking on his being a misunderstanding otherwise I am going to be breaking a lot of windows over the next few years.

    Being as this was my first vehichle other than my 88' supra which costs peanuts. I had no idea what a lien check was. So if anyone is going to buy a used vehicle get one of them. Then you have to have the truck taken off of their loan as collateral to be in the clear.

    A buddy of mine bought a car that supposedly was legit. When he went to register it - turned out to be stolen... Wow - that was a huge mess!!

    Crazy.... I would think the BANK would not loan the money of there was a lein and they would check before loaning.. (unless you put forth other collareral than the truck)
    if you default they get the truck.... otherwise they would not just give you a good faith loan?

    Maybe he can loan you something since he has so many vehicles?

    Lots of folks look like they have their stuff together, looks are deceiving and sometimes why they have sooo much money. They use other people's abeit whats going on right now in the US.

    Seems funny the dealership hasn't cut a check to TFS in like 4 months? Paperwork overload or lost on someone's desk?

    That sucks...but something sounds really 'fishy' -almost like you're being setup for fraud.

    Did you have the title transferred to YOUR bank or your name?

    If that title still belongs to the original lienholder - and that guy sold it to you knowing that you didn't tranfer the title.....he can claim that truck as being STOLEN (or something to that affect).

    If the title was never transferred over to you - then you might be screwed.

    How did you buy something the bank had a lien on? They wont release the title until it's been paid.
