    Not that $150 is anything to sneeze at, but is that really going to offset resale/trade value losses? Not that I think the resale/trade value was effected at all anyway.

    Filed it with my owner's manual (as per instructions ... in the event of resale). The fix for Tacomas is the brake override software they flash into the ECU ... Hold down brake and accelerator pedals at the same time, and power is cut to the engine. If you got your gas pedal shaved, they probably already did this too.

    Is anyone else surprised that we are automatically participants in this class action (and that we have to in fact contact them if we want to opt out)? Kind of ridiculous. Too many lawyers in this country apparently.

    As far as I can tell there really is no $ available here unless you sold the vehicle between September 2009 and December 2010. The only other fund established appears to be for vehicles not eligible to have a brake-override-system installed and I think the Tacoma are eligible (I think they did that to mine anyway when I took it in for recall; ECU flash). So whomever was claiming they are going to receive $150 (for reduced value?); what are you basing that on?

    Class action suits are usually set up that way.

    You need to opt out if you want to preserve your right to file a separate lawsuit on your own.

    Yeah. I had never looked into it but would have thought one would have to be cognizant of the issue and opt in to such a thing (class action). Just surprised that they have the right/ability to represent me when I have not consented to them doing so or in any way whatsover indicated that I need represented for anything lol. Just seems kind of f***** up. Everytime I have to work with the company lawyers (even just the IP guys) I cringe.

    What I dont understand is that they are saying it is related to the electronic throttle. When this whole fiasco started it was from the floor mat getting trapped on the gas pedal.

    It's not new, it's not Mexico
    The lawsuit is about perceived loss of the value of Toyota vehicles because of the bad publicity from the news stories. There was NEVER anything wrong with Toyota cars or trucks.

    Toyota's recall involved replacement (or trimming) of the throttle, along with a reflash that idles the engine when the brake is applied.

    That provides a path for the attorney to present to the jury that Toyota was aware of a problem in the electronic throttle control without admitting it.
    If the jury buys it, the jury buys it.

    Apparently, the jury bought it.

    If you go to the website, and fill out the info, at the end it tells you what your expected settlement amount is (if any).


    Toyota settled out of court, so a jury never had a chance to hear it.

    Calculated risk management.

    Traffic signal maintenance company I worked for settled out of court where a pedestrian crossed against a red and got whacked.

    Why? The "pedestrian" was mentally disabled, and BEFORE the accident was already a parapalegic in an electric wheelchair.
    Accident made the kid a quad. There was no way in hell our attorney was going to let a jury see that kid in a Los Angeles County courtroom (LACo is known to civil attorneys as "The Bank").

    Did you sell your vehicle during that time frame? I thought it was implied but was this for your Tacoma (or another Toyota that the family owns)?

    Any vehicles that were covered by the Toyota recall.

    Vehicles that were fitted with the Denso throttle were not covered, only the US-made (CTD I think?) throttles.

    The only specifics I read were that $ would be available to you if 1) you sold the vehicle or lease during a certain time frame, or 2) had a vehicle that could not be outfitted with a brake override system.

    Also if Toyota has settled for 1.1 billion, yet the settlement website indicates the mailers have gone out to 20 million owners...let me check my maths here...not everyone is getting paid $150 (lol).

    Not even close to $150.
    That's $55 per mailer, but the attorneys are going to get between 30% and 50%, so it's closer to $30 per mailer.

    You fill out the form, and it tells you what the settlement will be.

    I would assume that not everyone who has the mailer will qualify, and of those that do they won't all get the same amount - in past settlements that I have been a part of, that has been the case.

    Still, it's basically free money if you qualify - and if you don't take it, someone else surely will.

    My 2011 Tacoma kills the gas with the brake my 2002 VW did and so does my wife's 2006 Scion. Some one's going to make money and it's not the Toyota owner. Op out and see how it plays out good if the lawyers win then you can sue after the fact.

    BUCKLE UP! It makes it harder for Aliens to pull you out of your Truck.
    I'm not bothering.

    I've been as critical as I can be and must say the truck has been good, I'm even starting to think great.

    You know the TV Commercial where the Subaru Tribeca drives down the street? When I drive down the street, every vehicle that passes me (and that's everyone) including Tribecas simple don't hold a candle to this truck. Everyone knows it (because I can see their little brains exploding inside their little heads)

    3 years in and I'm very pleased with the truck.


    Good job by the people at Toyota, IMO.
