Dealerships have insurance of their own... have them fix it and file a complaint with Toyota Corporate. That service guy needs to be reprimanded for asking you to commit fraud.

I really don't have a problem with questions but people should do some thinking first.

Props to you OP for not claiming from your insurance. Since Florida has the no-deductible windshield replacement law they probably thought that this would be a cheap way out for them. The sad thing is that there are so many people out there that would have done the wrong thing just to get the 50% off coupon....

I'm glad he did too as I find it interesting.

I'm always amazed that people get on a chat board and then are surprised by...wait for it...you guesses it, random chatting. Ironic isn't it.

I would also specify I want a factory toyota windshield.

I know some say the aftermarket safelite units are ok, but after them trying to use my insurance I would want a factory unit for sure.

Contact Toyota corporate, the dealership owner, and I would not let them do the fix. Take it to another dealer and let the dealership where this happened know what you are doing to see if they will agree to pay for the installation if you bring them the bill. Do not mention how it happened at the other dealer and pay for it then take them to small claims court if they will not reimburse you. Let them know each step of what you are going to do.
I would not do business with that dealership as long as they keep that tech person who tried to get you to break the law.

That just makes alot more work for the OP. Goal is to get the windshield replaced, not end up in court.

^ Though I do understand where savedone is coming from.

I just got back from the dealership. I decided to go in person instead of doing anything over the phone. I sat down and explained everything that had happened with the service manager (the higher ups had gone home already). He seemed genuinely mad that one of his people could have suggested something like that and assured me that when the truck is fixed tomorrow that I will be sat down with the assistant manager and manager. I am still planning on calling corporate, but I'll wait to see how everything ends up. The service manager has already promised that a serious reprimand, suspension, or something more will come of all this.

Thanks to everyone for all the advice. It was a serious help.

I never would have expected this. I would suggest keeping on them about this. Since that it's happened this time, more than likely it's happened before. The shit storm that could come upon the dealership is huge. Keep us posted about this.

I am by no means defending the service dude but I think insurance fraud has become so commonplace that some people probably do not even think about it. Most insurance companies recognize the deductible games that they just concede and have deals worked with repair cos.. Body shop near work has a big banner claiming no deductible. What do you think adjusters think when they see that. That said I think the dude is in for a little more than a reprimand. He might have thought in his mind he was going the dealership a favor. Some people are shortsighted and not a lick of common sense.

Whatever anyone at that dealership tells you, every bit of it will be an attempt to cover for themselves.

Call corporate, they need to know.

This was not insurance fraud. Read below.

Florida has some interesting laws in regards to insurance companies. In Florida, the insurance company is required by state law to replace a cracked or broken windshield, without a deductible, and without any changes to a customer's rate. It is part of Florida's way to keep people from driving around with a broken windshield. The OP would not get into trouble for calling and making a claim, because REGARDLESS of the reason for a broken windshield, the insurance company is required to replace it. It does not matter if it was broken by a rock, or by a person working on the vehicle.

I think maybe the tech thought he was saving the dealership some money. VERY bad form in his case. When the tech told the adviser the adviser's FIRST step should have been to contact the service manager. ALL personal property damage should be brought directly the the service manager immediately. Then the manager could have taken the right steps then to take care of things. I think the adviser was being dumb in this as well.

    Good suggestion to be safe.

I think the service manager is taking fair steps. I applaud you for giving the service manager a chance to make things right. One misguided bad apple can ruin the bunch.

The manager stating that a reprimand or suspension will come of this is a good step. While the tech didn't actually suggest fraud, we don't know if he knew the auto insurance laws in Florida or not. Without knowing what the tech knew, we will have no way to know if he was being malicious, or just being dumb.
