    Hard to believe this crap! I feel for you. Maybe take the check+diminished value check+parting out truck=chunk of cash for new truck! Her insurance should definitely be picking up the tab on rental,at least that's how it works here in MA. I went to rental company day after accident ,told them what happened and gave them the other persons insurance info. Yea, they were pissed but couldn't do anything,their party was at fault! Hang in there!

    This. Don't let them tell you that "her insurance isn't enough to cover anything. Insurance is insurance...if amounts total for the accident are above her policy limits, that is her fault/responsibility/problem to deal with her insurance company. Get a lawyer. You should be made whole if it is her fault, not paying for rentals and loosing money. That's the whole point of insurance.

    Now the insurance company is an investment company. The longer they can wait or not even pay you, they will try to do so. That's why I say get a lawyer...might be cheaper in the long run.

    If you have Uninsured / Under-insured rider on your policy that should cover the rental and then your insurance company can go after her personally for the cash.

    While he SHOULD be made whole, if he does not have uninsured/underinsured, in California, her policy limit is the max he can recover through insurance.
    Anything else he will have to file a claim directly against her, either in small claims or a general civil lawsuit. Small claims, lawyers are not allowed, and it's a pretty simple process to get the judgement. Once the judgement it filed, he can file a lien on her property or even seize and auction her vehicle(s) to satisfy the judgement.

    General civil lawsuit, the attorney fees would quickly exceed the value of the loss.

    So i will be getting my truck back in 2 weeks. Body shop is reputable and they are fixing it the way i want it back.

    The all pro bumper really did it's job and since it's a 3 piece bumper, we only had to order the driver side piece.

    I will be filing diminished value against her insurance and once this is all said and done i will be shopping for a new insurance company. I feel like i need a more reputable company and better coverages for the future.

    Good to hear. As long as your happy with the outcome,that's all that matters. Just make sure you get that rental money back!
