Rear-ended on the freeway

    I got rear-ended on the freeway and remember seeing the headlights of the truck behind me approaching fast in the rear view mirror. The truck behind me rammed me and then he swerved to the left lane crashing to another car and ended up in the left curb of the freeway. I was able to stop my truck and avoided hitting the car in front of me. My dad appears to be fine, but my mom hit her head on the hard piece underneath the backseat headrest. (You guys should check out your backseat headrests. You will feel a solid piece just underneath it near the sides. It could be dangerous to the passengers in the event of a rear-end collision.) My mom suffered a minor concussion and was rushed to the hospital. She's still resting today and seems to be doing well now. The other parties involved suffered minor injuries according to the officer I spoke with.

    I'm not sure yet if there are damages to the frame, but my tailgate, bumper and the right side of the bed is wrecked. The right portion of the bed is pushed forward and dented the cab's right side where my mom was sitting.
    I purchased my truck brand new on March this year. I called my insurance and reported what happened. The adjuster will check out the damages tomorrow. This is the first time I've been to a car collision and I don't know what to expect in terms of claiming and so forth. Any advice would really help.

    The insurance company of the guy that rear ended you should pay for it, you don't file a claim on your insurance.

    You still want your insurance commonly involved. You pay them so they're supposed to fight for you.

    Yes correct, I just didn't want the op to file a claim on his own insurance for someone else's negligence.

    I think when injuries are involved he must report it to his own company. They usually pay the medical to start in most states. Hope your family is okay .

    Glad there are no serious injuries. The whole mess is a real shame. Well, it obviously not your fault. Hopefully the frame is OK or frame damage just confined to the bumper.

    You got more frame damage than just the rear. Insurance will have to put a new frame under it or total it.

    Glad everyone is ok, when you get this sorted out, could you post a pic of the hard piece on the headrest you are referring to? I'm having a hard time (no pun intended) picturing what part you are saying is dangerous to rear passengers.

    Also, try to go after this dudes insurance for diminished value, even if the shop makes this truck better than new again, you will have a resale value dropping accident on your trucks Carfax.

    My wife got a brand new 2011 Subaru Outback and was rear-ended a few months after she got the car. We kept the car a little while after, but it was never the same, and my wife wasn't comfortable with a car that was hit so hard previously. We lost $4500 below book on that car when we traded it for her 2013 Outback.

    Had we gone after diminished value, perhaps we could have recovered that loss.

    Glad you and your family are ok. That's the psychotic type of driver I fear when I'm on my motorcycle. I drive/ride mostly on RIGHT lane unless I need to pass to avoid angry/psychotic driver.

    Sorry to hear this, your frame could be bent and the truck could be totaled. Check into your rights in your state, do not sign anything from the other insurance company. Might need to get a lawyer.

    Good luck! Go after diminished value for sure. It will hurt resale of the truck, and if you're lucky push you into totalled territory. I'm not an expert enough to tell you totalled, but if there is frame damage I would want nothing to do with it.

    The taco took the hit pretty well. It did not throw me off my lane despite being hit on the rear right side and the brakes are just unbelievably strong I was able to avoid the car in front of me.

    Yeah I still couldn't believe what happened. I really love my truck and it's sad to see her like that.

    The taco protected my family well and kept us in the lane after such a hit and I was able to stop the truck and avoid the car in front of me. Outstanding brakes.

    Thank you for your concern. I will find out tomorrow what's going to happen after I speak with the adjuster. As I've mentioned, this whole process is new to me and I'm doing everything I can to do my research and listen to all of your advice. I really appreciate all the input and support.

    I'll find out tomorrow how my insurance is going to cover the medical bills. My mom is currently recovering from the crash. She's still in pain, but I'm hoping she'll get better tomorrow.

    It was a nightmare, but I was glad there were no serious injuries in all parties involved. I'll find out soon if the frame is okay when I get the truck checked up.
