EFFING DRUNK DRIVERS!

So my wife and I got side swiped in the parking lot of a local bar last nite. Funny thing was the guy in the F150 who hit us proceeded to park and went inside the bar and tried to continue drinking (had no idea he hit us). Had a deputy and all my buddies and bar security looking for him for almost an hour. Finally found him and the bar owner took his truck and got it towed away but the deputy couldn't do more since it happened inside private property. Sucks for us but at least he got stopped before he got back on the street and injured/killed somebody else I guess.

 

Must have been awful buzzed up not to feel that, some people are frickin idiots. That sucks, hopefully he will pay the price and thankfully he didnt hurt anyone

He could barely stand when we yanked him out of his truck (he attempted to leave). I've known my agent for years and he is really good so I'm not really worried about recouping any expenses I'll incur.

 

Your insurance claim will make his life hell with his insurance even without the DUI citation. Bumper upgrade time?

My girlfriend got her Nissan passenger side swiped like that. When it was parked with the passenger side nearest the curb. Go figure. We certainly couldn't. Took off the passenger side mirror and messed up the side panels and the rear fender. About $3500 in damages. Sorry ...couldn't find photos

Didn't catch him driving drunk. Private property, so can't give a ticket. Private property, so up to the drivers of the cars to work things out.

Do you want a cop giving you a ticket on your own property if you are doing doughnuts in your field? Owners of establishments don't want cops doing the same on their property.

I could be mistaken, but seems like in GA I have heard of people getting DWIs while sitting in a parked vehicle trying to sleep it off overnight. I assume some of those had to be public parking lots. That does seem like an over stretch of power though, I agree.

 

No. As long as the keys are in your posession you could be held to a Drunk driving charge. One of our friendly LEO's should be in here soon.

 

That sucks man. I know you were as pissed as I would have been. Hopefully there isn't too much damage and at least you got him off the road before he could cause more harm.

 

Why is the parking lot of a bar is considered private property

 

City property ends at the sidewalk unless a gov't owned building. A bar is a privately owned building, and the parking lot surrounding it. The owner has to paint his own lines, fix potholes, make sure the sidewalk is up to code, etc. If the city wanted to own it all, then they would just make it their property. Lots of little things go into owning/maintaining a business that most normal people wouldn't understand at first.

 

Similar thing happened when I bartended in college. An older lady wrecked her brand new MB into a cement light pole in the parking lot then took off with a friend in their car (why she didn't ride with them in the first place, who knows). Cops show up and stated they couldn't do anything anyway since it was on private property.

If I had a business and someone was doing donuts on my property I would definitely want a cop to give them a ticket

 

Then you as the property owner would have to file criminal charges against the person. If a cop sees someone doing it, they can detain them, and find the owner of the property to see if he wants charges pressed and damages paid.
