2013 Toyota Tacoma, Loaned to my brother and he wrecked it..

    Measuring frame today . having the appraiser come out a second time tomorrow or Thursday. Should know the final outcome by friday .

    This waiting sucks-continued. Three weeks after this weekend since accident.

    Frame is bent 8mm-46mm in separate places at pretty much every measurement point.

    They didn't even think about repairing it. They gave me an estimate of 17000 for damage before tearing down due to a replacement of a full frame.

    Things seem to be working in my favor.

    Good Deal. When the known/seen damage exceeds 70% of the value, it's considered a constructive total, ie, totaled. Start shopping!

    Already have my eyes set on a 2013 fj cruiser with 9k miles..going to try and grab it for 30k otd.

    California is weird with the total, they base total on value of truck crashed plus repairs. They value my crashed truck at around 18k for parts, so they said any more than 12k is going to total it. Which is odd considering the total value of the truck is 32k estimated actual cash value!

    Looking like it! Do you remember if they pay you "taxes" toward your total amount? For example if they settle for 30k, would they pay 32k to cover tax title license of a new vehicle?

    My Highlander was totaled last year. I got taxes for the old vehicle, not toward a new vehicle.....other wise people would ask for taxes on a 911 or something. OP has your brother made an offer to help make it "right" ?

    I would like to see the case law on this. Taxes are not their responsibility under law. I would be very surprised if they were required and unless case law can be cited then the answer is no.

    Therefore, insurers are strongly encouraged to immediately include the
    7% sales tax in total loss settlement claim payments to minimize the number of
    consumers whose settlements result in less than the full value of their claim. With
    regard to any consumer that is required to pay sales tax on a replacement vehicle, the
    sales taxes is part of that claim and failure to honor a request for reimbursement would
    mean that the insurer has not effectuated a fair and equitable settlement of the claim.
    This is true regardless of the date of settlement, the date of purchase of the new vehicle
    or the execution of release.

    Found it in a gov publication for Rhode island or something, so its definitely a thing.just need to verify California rules.

    Yes, insurer will have to cover the taxes. In Nebraska they will ONLY cover the taxes IF you buy a another vehicle UP TO the max amount of the reimbursement for your wreaked vehicle.

    Example: They reimbursed you $30k for your wrecked and you bought a new one for $35k. They will only pay you the sale taxes for the FIRST $30k, you pay for the remaining $5k. If you bought a replacement vehicle for $20k, they will only pay you the sale taxes for the $20k vehicle.
