My Tacoma has a BooBoo

I took off last tue, to finish moving and my buddy was driving my truck when this happened...

 

Damn, what's the story behind this?

 

The Pas window was not broken, just rolled down so my friend could climb out.


The Story:
Going to my old house to finish moving, I turned left into my neighborhood and looked into my rearview mirror to see if my friend turned yet and watched him get hit. I pulled a NASCAR turn and parked in the grass on the side of the road, threw it in park and was getting out when the old lady came down the hill to hit the truck I was in.

Now for the story of how he get hit...

He was turning left into the neighborhood, but before he started to turn, he looked and saw the car coming and watched her slow down dramatically and turn her left blinker on to turn into the medium. so he went, and she decided to not turn and get into the middle lane and that is why she hit him, if she would have stayed in the left lane she wouldn't have touched him.

 

^^ That's good err, bad I mean.

 

Also my friend walked away from it and the old lady that hit him had a cracked sternum.

it wasn't a complete roll over but there might be some frame damage since it was hit on the side. Hope everything turns out for the best.

 

I know this will not seem right, I would think it doesn't matter what the lady driver was doing, she had the right of way.
Your friend could be charged.
She hit him because he turned in front of her.

I hope the "Old Lady" is okay, you make it sound like she has some kind of sickness.
Also, you might be charged if she had the right of way while you were doing your Nascar stunt in the middle of the road.

I recognize that area, don't live far from there, guess it's just the Florduh drivers, they get you every time.

She hit both of you??

 

My NASCAR turn was through a parking lot, then I parked off the road in the grass, and she came down the hill and hit me after taking out a stop sign.

My friend did get charged for the right of way infringement, but there were multiple witnesses that collaborated my friends account of the wreck, and we believe the officer did not call any of them, we never saw him on his phone once...

 

as a licensed insurance agent and adjuster i can first tell you that what the police determine is never even a consideration when handling a claim. we do put the police report in the file, but it means nothing, we do our own investigation.

i bet you a 6-pack of corona this is what will happen.

your insurance company and her insurance company will investigate the accident. between the 2 companies they will decide your friend was entering the flow of traffic from a side street, the lady that it him still had ownership of the lanes of travel. your friend should have let her pass before entering the lane of travel.

your insurance will pay for damages, well for the tacoma and the lady that hit it. the other accident i would need more info to speculate how they rule.

From my experience, you really need the witnesses to stop and wait. I was hit on the highway and two truckers stopped and waited for the police. Not to help me necessarily but because the guy who hit me cut both of them off first, so they were mad at the guy. Either way, hopefully the old lady recovers and decides to leave driving to the youngsters.

 

In my accident the other insurance company was talking big until they got the report, two days later they called to tell me they would pay for all of my damages, and that was that. Seems like the report played a very big role in my situation.

 

This is why I never pull out in front of someone even when their turn indicator is on.
