    PHOENIX - Governor Jan Brewer and Attorney General Tom Horne announced Thursday afternoon that Arizona is filing a counter claim against the federal government for their failure to uphold constitutional obligations.

    Brewer said Arizona will file the counter claim on five separate counts:

    1. Failure to obtain operational control of the border
    2. Failure to enforce immigration laws
    3. Failure to protect Arizona from harm from immigration
    4. Failure to reimburse Arizona for more than $763 million in costs for incarceration of criminal aliens
    5. Violating Arizona's 10th Amendment, failure to protect Arizona citizens' welfare

    The counter-claim comes after the federal government sued Arizona last summer after the state passed SB1070, a strict law that allows the state to crackdown on undocumented immigration in new ways. That law is currently under review in a 9th circuit court, and has not fully been implemented.

    The Associated Press reports a judge blocked the most controversial portions of the law, such as a requirement that says police, while enforcing other laws, must question people's immigration status if there's a reasonable suspicion they're in the country illegally.

    During her remarks Thursday, Brewer said our border and immigration systems are still broken.
    "Arizona did not ask for this fight," Brewer said. "Arizona will not rest until federal immigration laws are enforced."
    Brewer also announced that Horne will join the fight against the federal government, and take the lead on filing the counter claim.

    “Security and border control is by far the number one issue in Arizona,” Brewer said.
    She said that no taxpayer money would be spent on the claim, and that she has set up a website to raise funds: keepazsafe.com .
    Brewer said she has already raised $3.7 million.

    Good luck with this. From a legal perspective, the only thing I can see in there that isn't strictly awareness-raising is #2 -- Failure to enforce immigration laws. The others might be resulting domino verdicts in subsequent suits, but not likely in this one.

    Arizona will have to show demonstrative evidence that the Federal Government was not only incapable, but negligent in enforcing immigration statutes. If found guilty of that, then the Government could face suits for the remaining issues, except probably #3 and #5, which seem to be state mandates and not subject to federal law.

    #4 is only applicable if the people being held are under federal jurisdiction and the state receives compensation for said incarceration. If they are held under state legislation, then there is no protocol for federal reimbursement.

    Finally -- what do you think this is really going to accomplish? My guess would be nothing, since improvement on border protection is incumbent upon funding, which is (you guessed it) tax-provided. Unless citizens of the US are willing to kick in another $100/year in federal taxes (likely? methinks not) to add additional support, there is no resolution to the suit.

    So, if I were a resident of Arizona, I would be pissed at Brewer for filing superfluous lawsuits that do little more than waste taxpayer money (don't be fooled by the money-raising initiative, state attorneys and staff are still paid from the taxpayer coffers and even if the total cost is refunded, the amount of time spent on this case takes away from everyday state judicial assignments, which is what your tax dollars are supposed to be spent on).
