I dont think i'll have a problem passing our emissions test up here in Canada, I dont think its as tough as yours. I could be wrong but I'd rather sell this than keep holding onto it for another year.

I have a 06 and the stock intake vibrates against the fender when the engine is cold. I know there is a TSB regarding this intake. I am out of warranty so no TSB for me.

Has the TSB been preformed on this intake?

no, i wasnt aware of any tsb's or even the issue you describe.
