Blacked out tail lights and insurance !

Is it true if you have your tail lights tinted/painted and get rear ended your insurance will not cover it?

 

It's entirely possible...You will at least have a fight on your hands. The insurance company can say "The blame is 50-50...Our client was following too close and you made it impossible to see your brake lamps. So everyone pay for your own and go on your merry way." At which point you and your insurer have to take the other company to court and hope it works out in your favor.

I've also heard horror stories about getting harrassed for stupid little things like that in CA...

In Louisiana, if someone hits you in the back, they're following too close. Black and white text right there. No ifs, ands, or buts. Found that out the hard way.

 

That only applies to the ticket tho...They will get cited for following to closely. That doesn't mean the insurance companies won't fight about it and/or divide up the blame.

I work for an insurance company, if you get rear ended it will be the other persons fault. Following too close and failure to maintain safe following distance. If the tail lights aren't working it could be a different story.

 

I don't agree with your blanket statement. No company wants to pay out...so they will look for any way to divide up blame. Usually it means that a client needs to say something like "his taillights were all black" or have the police mention it in the report, but they'll investigate it. I've seen it attempted before several times. Maybe not every time an accident happens- but plenty often enuf.

 

If you are rear ended it's not going to be your fault. Insurance companies don't divide liability on a rear end accident. Some "cheap" insurance companies might try to get out of paying but any of the big ones will pay for it right away.
If it's a intersection (t-bone) or parking lot backed into each other accident they will divide the liability, depending on the state it happened in.

 

So long as you can see the reflectors in ambient light within the housing, its legal.

 

Legal definitions are different state to state...Gotta check for your local area.

 

Since i went for the blacked look on my X and didnt want to tint my tails my buddy lenore got me a set of these for my b-day a couple years ago, there made by lund there stuck on with velcro, she said she got them off e-bay but she wouldnt say how much
