I understand that he's basically trying to ban them but how would his bill make the guns mag's truly fixed? I'm just trying to understand what it is that he is trying to do by removing the "loop hole". Looking for clarification I guess.

first of all, it's not really a loophole, ...since what the gun community there has done is work w/in the legal-ease of the stupid AWB ban there... secondly, ..w/out knowing the text of his bill (yet to be introduced?), ...he probably wants to add specific language to make the detachable magazine in them completely illegal (i.e. firearm shall not have any magazine that is removeable via finger or tool or any size/shape/kind/etc..)...

I'll start with the simple fact that what they're trying to ban AREN'T assault rifles. They're a semi-automatic magazine fed rifle. I have one,and I use it for target practice as well as predator and woodchuck hunting. NYS defines an " Assault Rifle " the same way as the Brady Bill did. Their rules on AR-15's are simple. There are certain features available elsewhere that are a "no-no". Threaded barrel(removable flash hider ) and the big 100Rd Beta magazines are not allowed.You can't have any more than 2 of the following.

Collapsible stock
pistol grip
removable magazine

All they're doing is trying to make themselves feel better by limiting honest people.And uneducated people believe them. But these politicians get to have security details ( paid for by US ) that follow them around for protection. They're of the belief that they know what I need or want better than I do,and I'm too foolish to make my own decisions. I mean really...why would I ever need to defend myself? I'm just a nobody,not someone important like they are.

The criminals don't care about the laws. THIS IS WHAT MAKES THEM CRIMINALS. These fools seem to think that if you take ALL guns away from people that it'll be a peaceful Utopian society.

The bigger issue here is that if you let them take "this" type of gun away,then take "that" type of gun away,eventually they'll have taken everything away. They won't come in and say " We're taking all your guns " They'll say "We're taking only this DANGEROUS,SCARY,CRIMINAL kind of gun ". Then they'll go after another,and another. When they're done the criminals will be the ones with the guns.And the average citizen will have to rely on the police. I'm not bashing the police,but they just can't be there to stop every crime. I'd rather have the right and ability to defend myself if need be. And to do whatever hobby I enjoy as long as I do it legally and safely.

All of the negative press that guns have received over the past few years ( Columbine,Virginia Tech,any one of a number of others ),and not one of those guns did it by themselves.

We're actually talking about assault-style weapons, not assault weapons. Military assault weapons are fully automatic (fire repeatedly at a high rate of speed when the trigger is pressed), while assault-style weapons owned by private citizens are semi-automatic (fire only once with each press of the trigger).

Absent that automatic fire aspect, why do the military, police, and similar organizations prefer assault weapons? you guys in California are getting screwed all the way around. how many of you now that a bill to ban the use of dog for bobcats and bears passed yesterday!
it is a bill brought on by hsus well because they can and if you think this has nothing to do with you because you do not hunt with dogs you are dead wrong!!!!!!
the more right that are taken away the more money HSUS has to go after even more of our rights.
gun owners, sportsman, farmers even pet owners need to wake up and understand that if HSUS had its way. no one would even own any pets or livestock and we would all be tofu eaters!!!!!!!!!

for any of you that do not know what HSUS is it is the humane society of the untied states. it has nothing to do with your local animal shelter!!!!! and only about 1% of the money they get from all those sad TV ad's goes to helping the animals in those types of ad's the rest is used to lobby to take our rights!!!!!!!!!!!!!!!!!!!!!

Loophole puts public at risk by allowing military style weapons with detachable magazines

SACRAMENTO – California has some of strongest gun control laws in the country, however gun manufacturers are getting around one the state’s most important assault weapon laws. The loophole allows ownership of a semi-automatic weapon – such as an AR-15 and AK-47 – that has a magazine which can be easily detached by a small magnet or the tip of a bullet.
Today, Senator Leland Yee (D-San Francisco/San Mateo) introduced legislation to close the loophole.
“There is absolutely no reason why these military style weapons need to have such easily changeable magazines,” said Yee. “While most gun owners are law abiding, I am deeply concerned with these assault weapons getting into the wrong hands, resulting in mass casualties of civilians or law enforcement officers.”
Magazines, or the storage areas that allow for repeat firing, that can be removed by a normal push button in combination with features such as a pistol grip and telescoping stock are banned in California. The law essentially requires magazines to be fixed, or removed or replaced with the use of a tool, in order to slow down the process of reloading.
To get around the law, gun makers have created a new mechanism, or “tool,” that allows the magazine to be easily removed by the tip of a bullet or in some cases by just putting a small magnet over the “bullet button,” basically recreating a normal push button and allowing magazines to be changed within seconds.
“These conversions are circumventing the spirit of California’s assault weapon statute,” said Yee. “Absent this bill, California’s assault weapon ban is significantly weakened. For the safety of the general public, we must close this loophole.”
Josh Sugarmann of the Violence Policy Center agrees. He recently told CBS 5 in San Francisco, “If the bullet button assault weapon is allowed to come into the state then the California assault weapons ban basically doesn’t exist anymore.”
"Unscrupulous manufacturers are purposely circumventing California’s Assault Weapons law,” said California Brady Campaign President Dallas Stout. “For the safety of the citizens of California and the protection of law enforcement officers, we must close this loophole.”
Yee removed the contents of Senate Bill 249 and replaced it with the new assault weapon language. The bill will likely be considered by the Assembly next month.

Eh, I don't know. I see both sides of the argument. The magazine is still semi-awkward to release beings you have to use a bullet or something pointy to release it. On the other hand a recessed button in my view could be argued as"tool-less".

Yes we can own handguns, I currently have 3 pistols, a bushmaster 16" A2 and a few hunting rifles. The bushmaster may be limited to 10 rounds using a "pistol" mag 5 with all other mags but atleast I can remove mine. I wish you guys the best of luck with this battle.
