Might not be Trail Gear but looks VERY similar. I agree it just looks like they were welded to angle downward instead of up like most people do.

trail gear ones could easily be made to be just like this if you don't buy the prewelded ones and set the angle of the slider yourself.

Yes, they would get caught on more obstacles.. not ideal. Most likely those guys did it since they thought it was a "nerf bar"...

Not necesasrily "bad". You will lose clearance for sure and contact the sliders more often, but they will still work the same way and there is no loss of strength etc. Clearance is the only downside to this approach. Most people usually want to gain clearance rather than lose it.
