    My uncle owns a $1700 car. He was driving 65mph when a Denali that was waiting in the median(tuning lane) decided to shoot out in front of him. His car was totaled and he was taken by ambulance to the nearest hospital. His ribs are bruised, left wrist is broken, both elbows required some minor stitching, and both of his knees suffered lacerations. This all happened on August 19th @ 0230, he was released at 2230 that evening.

    The driver of the Denali was a 19yr old female. The vehicle belongs to her parents and had insurance that plainly states she cannot drive. Today her insurance company finally gave us the denial letter stating that they will not cover anything.

    Their vehicle was a rent to own, they live in government apartments. Our insurance company says that they don't advise suing because they don't have anything to take.

    The things I wish to do are illegal, does anyone here have some advise?

    My uncle's bills as of now are $1500 doctor, $5000 hospital, we are waiting on the ambulance bill. The car will be given to the salvage yard for their fee, hopefully. If they won't take that it will be a $600+ charge for storage and pickup. Luckily he is a veteran and we can drive him 2hrs away to a VA hospital.

    They may not have anything to take but your uncles insurance company will sue their insurance comapny and get him paid. Stay on top of it and don't give up. insurance companies do all they can to make you walk away and take a hit, just keep pushing it and you'll get paid. The girls family has liability coverage for this exact reason and tyhere is money there that your uncle is entitled to

    They did mention that we can put a stop to that young lady getting her license in the state of Louisiana. From my understanding because the girl wasn't covered by the insurance company the insurance says they have nothing to do with her or the accident. I don't see how that can be.

    You are correct in wanting to pursue this matter. Every single insurance policy requires "liability" to cover other drivers. In the event if insurance policy of said party is "bare minimum" then he or she may personally be liable for remaining bill. While policies differ the payout is limited to lets say 300K, 100K, 25K etc. In event when lets say a really cheap car crashes into an expensive one that did not have full coverage then owner of the damaged car can legally pursue you in court to cover rest of the damages that your insurance policy may not have covered.

    In your case I would highly advise to hire one of those accident lawyers that are all over the radio. They will gnaw every single penny out of other insurance provider. But do keep in mind that if other insurance provider has lets say $10K personal damage coverage then that is all that said insurance company will agree to pay. Rest could be dumped on family.

    Since family is poor then your only option is to pursue insurance company. Now in event if your uncle also had a bare minimum policy... that might complicate things since he probably does not have personal bodily injury protection. I think your insurance company is telling you to drop charges is because they themselves do not want to cut your uncle a medical expense check if he is eligible.
