The nice thing about this country (or used to be, anyway) was that we can use our rights as we see fit, within the bounds of the law.

Is the guy an ass? Yes. Was it necessary for him to put on this little dog and pony show? No. Would I want to be his buddy? No. But it's not like he was holding up traffic any more than the checkpoint, and he didn't do anything illegal.

The thing that really strikes me is the professionalism of the officers. No bullshit. No intimidation tactics. Kudos to them.

    Exactly.

As much as he's using his rights, a simple yes/no would of been sufficent as well. Theres no reason to waste the cop's time, when there could be a drunk speeding towards the checkpoint killing all of them. I guess they figured he was sober to ask them questions, politely, and then repeat the SGT's name perfectly. The only thing thats weird, is they were perfectly fine being recorded.

This is what some people on T4R.org are getting at.

What's the big fucking deal? How is this unconstitutional? The cops are trying to keep streets safe. If you don't have anything to hide, why not just answer the question and move along?

Why would that be weird? I would invite anyone who wanted to to film me at work, if it were legal (HIPAA confidentiality).

I don't think the checkpoints are unconstitutional. Some people say that falls under search and seizure without probable cause. I don't see that, because there's no searching and seizing going on. The questions are meant to establish probable cause if it exists.

Is the word "No" really self incriminating??

They already were evaluating him from the time he rolled his window down. He didn't need to say anything to get popped if he had been drinking- So yeah- he was acting like a jerk and not even saying "I am exercising my 5th amendment rights"

They werent nervous, or acting like they wanted to interrogate him for recording them in this process, when more then likely it never happens.

Just something the normal person dosent do I guess. I'm not law enforcement, I don't know how they are trained to handle this kind of thing?

Instead of being silent, couldn't he say "I am maintaining my right to stay silent under the 5th amendment" to keep the time wasting to a minimum.

The first policeman asked him to put the car in park, unsure if he actually did or not, almost like they were going to ask him to get out to do a sobriety test.

I can see how it would be different if the dude was drooling on himself or something.
