    last tuesday a car merged into me in my daily driver. I filed a insurance claim immediately after the accident. Police responded and i ended up getting the ticket (that i plan to fight), also i complained to the officer that i couldnt remember a damn thing and that my neck hurt, he just ignored me. the lady claims i rear ended her with the passenger side of my truck, when i started remembering and telling my side of the story i said she merged into the driver side of my truck....insurance is telling me to just take the fault since i got the ticket, all my skids show i was in my lane, and even show i was pushed off the road. the officer told me the ladies story made no sense but i got the ticket cause in NC you have to be able to stop in time to avoid an accident no matter the situation. I had a witness but they said he wouldnt count cause we went to the same high school, even though i was in a different grade than him, but i also knew the officer that responded and we dont quite see eye to eye

    well today i have to turn in the rental, neither the liability nor the damage adjuster have communicated with me since wednesday, all i know is my truck has a 90 percent shot of being totalled, nothing else, they wont pick up their phones or return my calls. I need to hear something, so what do i do? and ya think i should fight the ticket, go to court and risk being sued?

    I'm more than a little stubborn so if it wasn't my fault (and it doesn't look like it actually was your fault), I'd go and fight it. Get LOTS of pictures since you said there are skid marks showing you were in your lane and got pushed off the road. The only thing I would caution you on is it looks like you hit on her back half. In some states, if someone pulls out and you hit their back half, they'll say it's your fault because you should have had enough time to either stop or swerve. I'd still fight it, looks like BS to me and that cop just had it out for you.

    I told the officer that she merged into my drivers side from the middle lane like she was trying to turn into the shopping center, she claims she was in the same lane as me and that i hit her with my passenger side on her passenger side about 300 ft back

    From the look of the damage in the pic I'd think your story was true. How could you have done that damage if you were behind her? She merged into you and doesn't want to be at fault it sounds like.

    And that's one problem about small towns where everybody knows everybody. People can become very biased. And if that officer ticketed you because you two don't get along very well, then that needs to be addressed and investigated.

    Talked with the liability adjuster. He said I need to take fault because of the officers report and him putting me at fault. Also because the officer wrote down the ladies story and not mine. He said because she claims she was infringement of me not beside me that I had an obligation to stop and because we have no valid witnesses that it would Abe hard towing incourt

    That cop sounds like a scum bag... He wrote you a ticket because maybe you picked on him in grade school but yet a credible witness is thrown out because he attended the same school?? That's BS, if the witness tells his story and signs that that is what he saw, the fact that you went to the same school and MAY have known each other is irrelevant.

    I can understand why your insurance adjuster is telling you not to fight it because it is an uphill battle. Just venting because cops like that give LEO's a bad name.

    How can you "rear end" someone and tear the shit out of the sides of their vehicle?! I don't even really see marks on the "REAR END" of that vehicle.. It's blatantly obvious that she merged into and wasn't paying attention to what she was doing and is jus trying to cover her ass. Is she hot? I bet that cop thinks he's gonna get some poon for covering her ass.

    Talked to another agent, he said not to fight it because it would end up costing the ins. company more in court costs and based on past experiances juries in the area tend to be biased to what the police report says. I found out that i do have accident forgiveness though and my policy is in my moms name so the choice is ultimately hers to make. I am supposed to get the call on if its totaled or not today but as it stands its still 50/50 with it.

    That sucks man...I had someone back into my car several years ago and the guy's buddy "witnessed me cutting him off," getting him out of a ticket and liability for the incident. People fucking suck.

    OP sorry to hear all the crap u r going thru...I was an Agent for GEICO and let me tell u about NC laws for insurance it is the most f**ng backwoods bullshit u ever saw, iam not putting nc peopeldown just the BS insurance laws...when we had training for the NC license it was a whole 10 day class in it self all the other states just gave us a license, I agree with aLL the other people saying not to fight it just because u r in NC if another state I would say fight it until u win and u would win in another state but not NC, let your mom take the accident forgiveness and move on. All the dirtbags that are involved(cop and other driver) will get thiers in the long run. Keep your head up and glad u are alright.
