Seems like a normal felony traffic stop to me, which I believe was warranted from the information they had about the plates and truck description (which for all they knew, was correct as far as it being the subject of a robbery case).

It does seem a little weird for them to not give any information for an hour though. I usually give LEO's the benefit of the doubt, and obviously none of us were there so we can't really comment on the specifics.

I don't think they were arrested, they were detained and released, right? No mugshots were taken or fingerprints?

Anyway, you have to consider that when the plates were run and there were suspicions, the cops have NO idea who they are dealing with. They are basing things on the plate info and the description of the vehicle.

There were three of you. If they were to say "We are stopping you because this vehicle may be involved in a crime" there are increased chances that there could be a run off. Not disclosing it right away, and if you WERE indeed the bad perps, then perhaps they can go on the chance that you could be thinking "Oh hey, nobody got the plate when we robbed the place, we are being stopped because we turned off kind of fast and look suspicious.."

They did in fact tell you why they pulled you over and detained you albeit later than you would have preferred. They needed time to run checks on all three of you.

But my question out of curiosity is (should you decide to file a complaint) what charges would you be listing? What rights were violated? Not challenging you, just honestly want to know what you would be filing.

Nope. The shop closed at 6:00pm, we were right on time but then this clusterfuck happened.

Had to put the old bearing and hub back on the truck. Started making louder noises today on the way home.

Fingerprints AND photos of all three of us were taken, and I signed something I couldn't read because it was dark and was on the hood of a cop car on the side of a freeway.

I'm going to consult my lawyer and see what he says. I think the other guys are doing the same.

Hypothetically speaking, if the crime in question was because of a false police report, or falsified account, would that constitute us having some sort of case?

Wow. So if they take pics and fingerprints at the side of the road now? Wonder why? Usually they do that when they take you in and you are arrested. Okay I see your point now. That's crazy.

Did you get a copy of what you signed? Were you read the Miranda?

What are you wanting to get out of the police? An apology? Reparations for traumatization? I'm confused.

No Miranda rights were every read to me, and I received no copy of anything.

What puzzles me is the fact that they "somehow" knew the three of us were not suspects in the crime...but Brad's truck WAS? He has never loaned his truck to anybody...so we are not clear on what the police report in LA contains on this crime.

Doesn't seem odd. You guys were in a truck, matching the exact plates and vehicle description, the cops pulled a felony high risk traffic stop, detained you for the length of time it took to investigate the situation and let you go.

BULLSH!T! If they have a tag and description they'll move on the truck at the address of the owner! (Unless they're complete morons, which is possible in Commifornia) Make them prove it! This is one of the reasons I don't live in Commifornia anymore!

On another note, you guys do look guilty in your pic. :poking:

Also, you are very lucky that the evil little black rifle next to you didn't just jump up and start killing everyone.

Full confessions can be hard to beat in court...lol. Now, I would be conerned. Not that I think the cops were out of line (based on what I've read) but, I would not have signed anything without being able to read it....

Well Brad doesn't have transportation to work and school, indefinitely. The supervisor said it would be AT LEAST a few days IF WE'RE LUCKY to get the truck back. That is an inconvenience all in it's own, especially since is not being charged with a crime but his truck is being investigated, though it was never stolen or loaned to anybody.

You dont get read your Miranda rights unless you are arrested. They never arrested you so therefore they arent required to read them as far as I know

    thats why.

I wouldn't be surprised if they fight the guy on giving him his reimbursement. I am of course not an expert with felony traffic stops and did not realize this was propor procedure but it sure seems like a whole lot of BS to do that to 3 innocent people just driving a long. An hour detained in the back of the car with no idea why? I didn't realize suspect felony traffic stops based on eye witness descriptions of a vehicle (bet the description was "black midsize truck with black wheels, or something equally vague) meant the people being pulled over in question were treated like that.

Put yourself in his situation. Would you happy for them to take your only mode of transportation to your occupation and school obligations without knowing WHY? And it's being impounded for a while because the detective on the case is on vacation and cannot be reached.
