Exclamation New Homeowner Situation NEED ADVICE

Last friday I officially closed and bought my first home for my Fiance and I. It was a long battle given how the market was but we finally landed a home in a great area. When we were doing walk through s and first seeing the home we notice that the next door neighbors dog was a little territorial and would bark alot and than if you walked over to the common sharing fence between us and them he would bark even worse and growl. Than I noticed that the fence that we do share with them is actually very weak and falling over in some places and its design never looked like it was ever EXTREMELY strong. The opposite neighbor side has a very nice heavy duty fence installed between us (so my yard has two different fencing on each side). I would like to get the same style fence on the opposite side of my yard to the weaker aggressive dog side.

Yesterday we received keys from the previous owners and we asked about the dog and she had said that they did have some problem with the dog jumping on the fence and breaking it in some places. She did say the owner of the dog would replace some of the broken panels but the dog would just break them again so overtime he has given up.

My dilemma is I want the fence fixed for one bc I have a dachshund pup and I dont want to have to worry about him in my backyard. For two I do want there dog to be able to see into my backyard so that he doesnt know were back there when we are and bark his head off. Porblem is having the fence replaced isnt cheap and I feel I shouldnt have to pay alone but obviously with how bad its gotten that owner does feel the need to drop money in it bc he hasnt thus far. ALSO if I do replace the fence and his dog is jumping on it on his side I will be pissed!

What would be some of your guy's advice on what I could or should do??

Yikes.

I would collect a little intel on your neighbor. Maybe start by introducing yourself and don't bring up the fence, just go shake hands and see what's up.

I'd want to know what I was getting into before shaking him down on the fence/dog issue.

Is his fence the only part of his house/property in disrepair? If not, it may be an uphill battle.

In one of our first houses we installed a fenced in dog run a few months after moving in and our Lab would be in there while we were both at work. What we didn't know is Zeke would bark all day long. Our neighbor, whom we had come to know pretty well, brought it to my attention and I addressed immediately with a barking collar.

My point is, there's no harm in casually assessing the situation. You could learn a lot about the guy just by how he reacts to you knocking on his door to introduce yourself.

My wife and I have purchased 6 houses and by the 3rd house I would case the joint all hours of the day to assess for dogs, trains and other shit that you never see doing a real estate walk through. I also tend to buy houses in acreage neighborhoods under the general assumptions that most neighbors will have dogs and most dogs will annoy the shit out of me.

I am a dog person, we have two. Both inside dogs and both are not allowed to nuisance bark. When they do, they come inside. When we aren't home, they are inside. I fucking cannot stand nuisance barking dogs.

Check with your local zoning board on rules regarding fences and dogs. Disputes like this can be messy and turn a happy occasion into a horrible one. My wife (code named Switzerland) always does the right thing and talks to to neighbors whenever we have issues. I'm usually the passive-aggressive one on matters like this. Her results are usually better than mine. Maybe a talk with the neighbor and ask if he would like to split the cost on a new fence?

Most folks share the cost of a shared fence, doesn't sound like that is a viable option in your case, I would approach him anyways with a couple of bids and see what he says. The problem is even if the dog can't see you and your pup he can hear you and smell you, he sounds like he might go bananas if he hears and smells your pup. you could install a chain link on your side in front of the fence. You have the right to reinforce the fence from your side in any fashion you see fit. If the neighbor doesn't want to play nice then I would start setting posts on my side and do whatever i want, chain link, wood, barbed wire, run a bunch of bare wire and juice it with 220V. If it was my house and his dog went after me, my dog or my family on my property, the dog dies the first time, period, no warnings and no second chances, I won't risk the safety of me and mine for some asshole's dog.

I'd look into a "fencecrete" fence. A concrete,wood looking fence. Not cheap,but the last fence you'll ever have.

Sounds like the neighbor isn't a real responsible dog owner, so you are probably not going to get money or help out of them for getting a fence put up. If you want a fence for your yard/your dog - Then I kinda think it's on you as far as who is paying for the work/materials.
The dog on the other hand sounds like a nusance....Likely can start with a discussion w/ your neighbor about it. But at the same time, keep a record of what the dog does that is annoying (video works well) and learn what your rights are.

I just ended ( hopefully) a property line dispute with my neighbor and it cost me about $1000 when it was all done. Unfortunately fencing and property lines are expensive, I really think your best option is to just pay for the fence yourself and set it up just inside your side of the line. That way it is 100% yours, plus you'll have a dual layer of separation between you and the neighbor.

I guess you could start with talking to the guy and asking him if he will split the cost but I wouldn't be too hopeful or expect much.

Teach yourself to lay block (it's hard) and spend a few weekends on it if the neighbor won't help out. Shouldn't be expensive at all.

Put up your own fence and paint his side of the boards pink... The people on the east side of me split the cost 50/50, the people on the west side collected money for the fence from their insurance company after Ike hit us but would not help with the replacement. I did all of the work myself.

alot of people do craZY THINGS when all they had to do was go and try to explain whats going on,......
maybe do a meet and greet with the dog.....

Thanks for all the advice guys. I definitely did walk through s of the house actually I did about 3 of them but I figured the dog situation was no reason to back out of escrow. Mainly because I do plan to meet the neighbors and possible ask if I can meet their dog as well to see if that helps. If not, I also figured I would voice my concerns and if he doesn't really show interest I would just have to take it into my own hands. Nothing MAJOR but I do agree with you OZ I have been leaning toward getting a new fence on my property line. And if he decided to tear down the old fence to gain the benefits of my new fence I just paid for personally. I would have to call code on him and show that his dog is damaging MY fence given it is on my property and let them take it from there. I plan to be as passive and kind as possible because I do not want to move into our first home with brand new enemies. Theres a ton of solutions we can take to try and fix the problem. This is just something I have been trying to plan out in my head on what my options are.

I definitely think that the previous owners couldve been the reason why there was not a updated fence put in because during my disclosure of the home I found out that they were actually in default and beginning the process of losing there home and I bought it just in time to not deal with it being a short. So with luck maybe the neighbors would love to pitch in for a new fence but my previous owners did not have the financial ability too. That would be the best case scenario
