common sense would dictate that killing people is killing people, if you do it you should face the consequences. If you are found to be mentally unstable enough that your disease effected you cognitive ability and reasoning you go where the rest of the people with serious mental health problems go...A FUCKING MENTAL INSTITUTION. you do not get probation then at 18 the ability to go out and enjoy life freely while 4 other people are dead.

    wtf

Well I certainly hope that $450,000 per year country club treatment facility at least tries to make that brat realize what he did.

Yea this case was discussed briefly in a few threads last week. It's really horse shit.

Who is responsible? Who should be punished? The parents? The courts (what will he do next)? The judge? The spoiled brat? The source of the alcohol? The brewery (people blame the gun manufactures)? Law enforcement for not catching him? The lawyers? The system that elected the judge or those who appointed her if she was appointed? The elected officials who write insane laws that allow an outcome such as this to happen? Should he just be "rehabilitated" & not punished?

I'd like to hear some opinions of what people think should be done.

Personally I think punishment should fit the crime regardless of the perpetrator. I mean laws exist to be found not guilty by reason of insanity or self defense but without failing into a different category (such as the two just sited) why should people be treated differently?

I know if I was a loved one of a victim I sure would not be satisfied with the judges decision.

When someone is convicted, they have the right to appeal.

When someone gets off because of some bullshit made-up condition, The People of the State of __________ should have the right to appeal.

I saw this in the news the other week. It is truly sad, and does show the old belief is true: Money can buy the law.

I see your general point in seeing the insanity of the criminal versus civil, OZ.

From what I have learned over the years is that civil and criminal cases are separated for a reason. It is not so much as "they couldn't be proven criminally at fault, so let's get them in civil court", but it is about the difference between a crime, and personal responsibility. For example, you are driving down the road and hit a patch of ice. Your truck slides into another car and causes damage. you didn't LEGALLY do something wrong, and can't be tried in a criminal court, BUT you could be sued in a CIVIL court for damages or personal injury.

Also, as memory serves, if one person murders another, even if they are found guilty, there is no monetary compensation in a CRIMINAL case. So then the CIVIL courts get involved to decide fault and compensation. Criminal cases do not take residual damages or "compensation" into account for anything. If there is a theft, or property damage, then the courts can demand compensation for damages, but not for things such as loss of income, or injury to another. Only a civil court can decide that.

This was not a jury trial, it was a plea deal. No jury was involved.

I can't believe a DA would make that plea deal with that agreed sentencing?

This kid deserves a Fucking smack. Then the parents should get a good slap. It also goes with out saying the judge is out of control with the decisions made. Time for her to go. Then the kid should get another smack for good measure. Going to some country club for "rehabilitation" will only add to this kids delusions. It's sad really, 4 innocent people lost their life because this kid felt he could do whatever he wanted (legal or illegal) unfortunately this probably wasn't the first time he was let off the hook and won't be the last.

I agree, or at least allow the prosecution the right to appeal (can they?). Like you said, if the defense is found guilty they can appeal. Why can't the family of the victims appeal the courts decision?

You know what the shittiest thing about this is? We can bitch and complain all day, because we know this isn't right.

But there's not a damn single thing we can do about it. And that's what really grinds my gears.
