TRD CAI NOT C.A.R.B. Approved but others are... why?

05 DC 4x4 - TRD Off Road - White

Round Step Bars, Bed Mat, Cargo Bars, Rocky Mounts bike mount, JVC MP3 Head Unit, TRD Cat Back Exhaust, Rigid Industries front and rear light pods, dual HAM radio with remote mount heads.

So can someone tell me why the TRD CAI isn't "street legal" in California and not C.A.R.B. approved yet I can get one from K&N or AirRaid that are approved?

What's the real difference?

I'd like to get the TRD one vs another manufacture just simply because I want all TRD parts (for the most part). Since I only have to do smog once every other year in this state I'd be willing to swap out during smog test times but if I can get away with leaving it in I will. Hmm...
