    Would the department of motor vehicles be able to help?? :confused:

    Just thinking that the dealer may have had only "x" amount of time to get the title changed over and if they didn't, maybe DMV could prove that it's on the dealer.

    It sounds like the dealer did not make a promise on how quickly they would pay off the vehicle.

    That's fine, but they DID agree at what price they would pay it off.

    They're trying to swing it like they owe this guy nothing, and are being nice and giving him $332.

    The reality is, in the eyes of the law, they OWE him $426 and are hoping $332 will shut him up and make him go away. Don't let them get away with it. If you push it, they'll give you your money.

    To give you guyz a clean picture here is the original invoice. Now ive already made a payment that owed for new vehicle ($5918) that i got from them. The name of dealer is AUTO LIQUIDATORS here in COLORADO SPRINGS, CO

    Is that a signed invoice? If so, I swear dude, you're golden, just demand to speak to the owner or at least the highest manager you can get. You can even just look at their staff online and see who the highest guy up is, call the dealership and ask for him by name.

    I guarantee if you mention the words "I have a written, signed invoice stating $15218, you took too long to pay it off, and I had to make a payment, now I'm getting shorted my $426 payment and this is wrong" their tune will change. If that doesn't work, tell them that the Better Business Bureau and Toyota Corporate would both be interested in fraud from a dealer. This. Is. Fraud. Dude!

    OK maybe the fraud thing is a LITTLE over the top, but they are going back on what is essentially a contract. Sorry for online-screaming, i really hate dealers sometimes. Nice truck though!

    You have signed paperwork! That is a contract. Walk in and ask to talk to the general manager, show them exactly what you showed us. There is no way they can deny they screwed up. If not punch someone in the face, then go into the mens bathroom and take a dump on the floor!

    I just talked to the manager and he said he cant help me any more. THey are sorry for late payment but they called the bank this morning and pay off value is lower and thats what they are going to pay and they are willing to refund me $332.21 He said they cant help me any more. Means dont want me to call him back. Do you all think I should talk to a lawyer on post? I dont have lot of money to spend on lawyers at all.

    Well consider that you are out $92...a lawyer would probably laugh at you. Small claims court is probably a waste of time as well, in time spent. You would probably win but who wants to go through that hassle? I think you try and smear them any way possible to the BBB or local news, or something like that. It sucks that they are assholes, and it sucks that you lost $92. Auto Liquidators sounds like a shady deal...

    Again, throwing shit at the windows would go a long way in your sanity.

    Don't spend money on lawyers, and if you did, taking the $332 would honestly probably be legal acceptance of that as being an OK way out of the deal.

    I would tell him that he has to help you, because his dealership agreed to do it. Force the issue - Toyota and the BBB would seriously have something to say about this, I would not hesitate to mention that. His reputation should be worth more than $92, especially with Toyota Corp.

    I agree that it isn't worth fooling with lawyers.

    What dealership is this? are you sure you spoke to the right guy?

    Edit: I see, you didn't buy from a dealer. Time to tell them you're ready to call the BBB, they're still at fault here. Or just actually call the BBB.

    Or if $92 isn't worth the hassle, you could just move on. *Shrug*

    Do like one of the other members mentioned... call the local news. I'm sure you aren't the only one this has happened to.

    Usually once the news gets involved the "situation" gets resolved. They agreed to pay a set amount.. they need to do it. They don't want bad publicity...

    When I bought my truck, i'd made another payment, but the extra was put in my savings account. My dealer paid what they said they were going to pay.

    The dealer is STEALING from you.

    DEFINATELY call the BBB and file a complaint.

    Agreed they are stealing from you & I hope you keep calling,. They can hope you stop because that is how crooks get away with this. Also most states have a consumer advocacy group as part of the attorney general's office.

    Sorry to here of your loss, but it just might be a cheap lesson, A liquidator is NOT A DEALER and could give a rat's A$$ who you call, I can guarantee you, this is not his first rodeo, You were selling something you did not own and he knew it, next time go to the bank or whomever you have the loan with and work back from that end, There are a lot of "Scumbags" out there so you have to be careful, If this is all it is going to cost you, I think you are pretty lucky, again sorry for you loss as I know you can use the money, Good Luck Doc

    Did you accept the $322.00 from the crook? If not, as the other members said, take the paperwork and shove it under his nose. It is written that they will pay the 15K for the car, not the 14.8K. Also, definately contact the news media, the BBB, and the AG office in your state and take the time to file a formal complaint. You may be out the 92 bucks, but how many other honest hard working folks have they pulled this BS on? These A holes need to be nailed on their shenannigans (ode to Chris4x4)

    My guess is that you also paid tax on the difference? They owe you a refund of those taxes as well. Perhaps you mention a call to the local and federal tax authorities?

    Good luck in getting what is rightfully yours.

    See if there is anybody in your town who is a lawyer who will provide free legal advice. You can ask here and a lot of well meaning people will try to help, but if they do not know the laws in your state and are not practicing licensed attorneys, they could be steering you wrong.

    The lawyers call this pro bono and they do it because they realize that there are people like you who need but cannot afford the help and they want to do something about that. At the very least they can tell you what options you have.

    This is a raw and shady deal. When I traded in my 07 Legacy for the Tacoma I still owed 12k. They made the payment that day and I never had to pay anything else on it. This is why I try to stay away from small used dealerships.
