RUDE AWAKENING- Dealership sold me wrecked truck with clean title?

    Paid $30k plus after stealership fees for a 2012 crew cab. Bought it a year ago. Finally got my wheels and tires last week and just got back from getting them aligned. Guy told me this truck has been hit in the driver side and the chasis is bent.

    He told me he aligned it the best he could. He went on to point out the slightly uneven gap between the driver door and front fender. Opened the door and revealed no stickers and no rubber grommets. Said this door has been re-painted.

    I was there to get a quote on a lift kit installation as well. He told me I could hit a pot hole and bend the frame more and this truck would be junk.... junk he said. I about puked. He told me to sell it.

    Called the dealership and the poor girl who answered the phone said there was no one there that could help me to call back Monday. I told her i'll be there in the morning.

    Now this guy seem pretty knowledgeable like he had been doing this for years. I assume the dealership might look at it. I assume they will pull out 1 of the 86 papers i signed and tell me tough shit. We will see Monday. #fukingIrate

    Has anyone experienced or heard anything relatively like this nightmare?

    2 in spacer lift front 2, in AAL rear [tundra leaf] , flip up tow mirrors, ARE shell electric brake controller and cooper ATP 265/r70x16 tires on stock TRD wheels
    Dealership sold you a used truck that someone had traded in or they bought from a broker. Either way its very possible that the dealership was not aware of the previous history.
    in some cases but not all a Carfax or similar report will warn you before purchase and should be made on any purchase of this size.

    Airbags did not deploy
    CARFAX began reporting this information on 02/04/2015.

    So if carfax added this information AFTER you bought it, then how would the dealership know about it? That would mean that they didn't intentionally mislead you.

    OH i dunno, the multi point inspection etc they should preform on the vehicle before selling it

    Very true. Unless they were the ones that 'fixed' it. Made it pass the pre-owned certified test and sold it to me.

    I was in a similar situation except for I bought a car from a private party up in Red Oak. Took it to get new tires and alignment and same thing you were told. Tried to go through the legalities and got no good news. Was basically told unless you can prove that they lied to you about the condition, it's on the buyer to thoroughly inspect the vehicle. That's were the "AS IS" that was on the window sticker comes into play. It sucks man. Really crappy situation. I hope yours turns out a lot better than mine did.

    It's unsettling that carfax took a year and 7 months to post the incident. That's unacceptable. You obviously can't rely on them. Sure I should have taken it to a different mechanic, but when buying a Certified Toyota from a dealership with 160 point quality inspection who expects the frame to be bent ffs.
    The carfax says 3 owners. the incident was the last posted on owner 1. So that means they got into the accident and either fixed it and sold it to the dealership -or- the dealership bought wrecked and fixed it. I could assume the later.

    It will be very interesting to see how they handle it. It is a very large and well known dealership in my city.

    The truck is still under the certified
    • 12-month/12,000-mile Limited Comprehensive Warranty
    but i'm unsure if that covers anything because it says

    "The Limited Comprehensive Warranty covers any repair or replacement of components which fail under normal use due to defect in materials or workmanship."

    I did buy a bunch of extra insurance and warranties from the dealership. Someone stole the envelope of all those papers from my truck unfortunately when they cleaned out my glove box.

    If it was Certified Pre Owned, one of their criteria is that it is accident free. Their inspection should turn up the evidence your shop found and it should have never been CPO. You have leverage on them. Demand a refund. If they resist get a lawyer and put it to them hard.

    There is a difference between minor body damage and a potential dangerous to drive vehicle. I'd talk to the dealer AND a lawyer on Monday. And probably not in that order.

    It's possible that CARFAX didn't have the info to post before that; not defending them but have seen that type of stuff before. They can't post/report data they don't have at the time.

    Before I spent lawyer money...I'd request an appointment w the owner or GM.

    I'd be pleasant and persistent. I'd try and negotiate a deal for another truck. Maybe a brand new one.

    Of course, I slide the lawyer threat softly at them.

    It's in their best interest to make this go away. They can wholesale the wrecked truck. And move a vehicle out of inventory.

    Years ago I purchased my ex (we were married then) a Toyota Sienna from a Toyota dealer in Idaho. It was Pre-Owned Certified and everything. After a couple weeks we began having issues with one of the sliding doors rubbing the body. Their team made tweaks to the door 'under warranty'. It began rubbing again so I took it back again. They tweaked it again and we never had an issue again going forward. However - We discovered a CarFax report showing the Sienna had struck a deer in another state when owned by the previous owner. The tech at the Toyota dealer who was repairing it pointed out a couple aftermarket (OEM look but without Toyota stamp) parts under the hood and showed me how it had been repaired. He believed that a slight tweak to the frame was likely the cause of our door rub issues.

    You would think you could simply trust a Toyota dealer when they sell you something that Toyota is trusting them to certify on their behalf. I guess you can't.
