I don't think any of that matters to the insurance company.

Insurance should also cover the car seat, ask them. If they say yes, go out and buy the most expensive all in one (seat and stroller) combo and send them the receipt.

For that to work you would have to declare all of your aftermarket equipment with the insurance company beforehand, so they would adjust your coverage accordingly. If you don't, all they would cover is OEM equipment and nothing else.

This is how it works with Mercury, at least.

duh. you are right. I completely spaced on the fact that the other insurance company will most likely be paying for it!

So heres todays update...Called his insurance company and told them i needed a rental. They said because they hadnt talked to their client yet they cant give me a rental yet. So today has been spent calling insurances, the bank that has the loan on my truck, and finding comparable trucks and their prices. Also adding up all the extras and mods i have done to it.

Glad everyone is OK. But I've been looking for a white tailgate. Do you have any idea how rare it is to find a totaled Tacoma? Once everything is settled let me know which scrap yard it is in and I'll give them a call.

Can't supply a rental because they have not talked to their client? That sound like Bold-R-Dash to me. Minimally, they should have supplied you with one of their "preferred vendors" with the understanding that if you are found "at fault" that you or your insurance company will have the liability. If you really need a rental, and they are dragging their feet (I would call my) call your insurance company and get one. Insurance companies share data through a common industry DB. So, if you file a claim with his insurance company, your company will find out about it eventually. Also when you insurance company calls his insurance company and their client, it may break things loose. Another point, since this is probably a total loss, you need to get the ball rolling because you need to get through the first round of adjusters before you get to their "Total Loss Division". A level one claims adjuster can only signoff on so much $$ without oversight. My 2 cents. I am a not an attorney, just opinionated. I do work in the auto insurance industry.

They won't assume liability until they speak with their insured. Standard practice with EVERY insurance company.

True. However, read the post. They should have supplied a rental, with the understanding that he or his insurance company will have to pick up the cost of the rental if they do not assume liability.

Nope. I am an insurance agent and a CPCU, I've been so for 29 years. They are under no obligation to provide anything until they speak with their Insured. That would put them on a hook they might have no obligation to be on.

Metrick1215, are you really certain your neck is OK? What about your vision? Any numbness or tingling in your extremities? What about grip strength? You could call that TV lawyer and trade your wreck for a check! Seriously, glad you're uninjured.

It's my money and I want it now! haha.

Seriously though, if their insurance is going slow you can always go through your own and your insurance will go after them for the money, that is if you have collision coverage and rent a car on your policy. Your rates should not go up if you do this if you are not at fault, at least with state farm. Best of luck!

I think you kid, but it would be a good idea for the OP to engage a competent attorney.

(I am not one, nor do I play one on TV)
