So received a call from his insurance today. She said they dont have any adjusters in the state of GA and would have to get someone to come and look at both vehicle before they could do anything about a rental car. She stated that hopefully they could get it done today. The other people havent gotten the police report so i sent it to his insurance company.

wow! they "don't have any adjusters in the state of GA".... Lawyer up because this might not be the "best" insurance company to be dealing with. What company if you know? I would be curious to challenge that assumption or for me avoid them at all cost. Sorry for your loss and family is definitely more important then metal (albeit it was a Taco) /Best of Luck!

Just the essentials and no extra fluff.
Honda got hit more than a week ago and State Farm has been dragging their feet. They have been unable to contact their insured driver so nothing has been done. The wife will be traveling this week and she's pissed because she gets to drive a busted up car.

Your talking obligation, I’m talking service. I am also speaking from personal experience. I had my car totaled about a year and a half ago. I filed the claim with his insurance company, about an hour after the accident, at the car rental counter. They had no opportunity to talk with their insured. It took a while to get out of there but I drove home in a rental.

Erie is one of the better insurance companies out there. They have a decent rep for paying off. They are a Mid Atlantic company as in Erie Pa.

i will do this after thursday if they try and really screw me over, ive already printed out all my receipts for all my extras this morning and searched for all Tacomas in my area 2007-2012 Prerunners and 4x4's, same size, and same motor within in the mileage range and less than 100 miles for sale. The general price is around $16500 which is what it would cost to replace. But ill have to argue if they go by KBB because it says 12Kish but thats not what it will cost to replace it.

You can request that they find the replacement vehicle for you.

Your best bet is to call them right away, even if you do not need their help. They do this all the time and can guide you through the process so that you get everything you are due with the least amount of hassle possible.

I was hit once and had a devil of a time getting the other insurance company to get their act in gear. I finally called my insurance, they called the other company and two days later I had a check in hand.

They may not need to intervene on your behalf but they can tell you if something is not like it should be or if you should be getting more of a benefit then they are offering.

do not under nay circumstances use HIS insurance to cover any claim, work with your insurance, I just had to go through this on a VW Touareg - 26k$ of damage and I chose to use the other persons insurance for the claim and have been screwed over at every turn. My attorney told flat out to use my own insurance even though it results in claim because their duty to you is different than the other persons insurance. No matter how nice they startout being they will attempt to screw you.

You really shouldn't wait, file with your insurance, you'll end up with the better settlement.
You pay them to represent you, that's what your insurance is for!

I have contacted one, and he is willing to help me. He said now that my insurance company is taking over let them work on it, and if anything goes slower or wants to look over the offer with me he will. I havent heard from Erie since Tuesday. My truck is being picked up today and is going to Copart in Loganville GA, for the ones that asked me about parts. ive thought about getting it back and stripping it but i have nowhere to store it while i strip it.
