help with a stop sighn ticket...LEO elp appreciated

ok i got done helping a friend put a new rear end in his chevy, at about midnight in a small town, got pulled over for rolling a stop sign (i did roll it aint gonna lie) was courtious to the officer (and actually learned something!) and he was courtious back, although he did write me a ticket. however on the ticket he got the time and my age wrong (time by 4 minutes age by 2 years) and he origionally got my dl # wrong and then he corrected it by circleing it (supposed to be a 0 he wrote 1 and circled over it) also he never made me sign where it says i aknowledg reciept of this citation and agree to go to court for the applied charges ect... and he didnt fill in that date


any way i could possibly get it dropped reduced? he was a nice guy and i was nice back, after all he caught me fair and square and it is his job, heck he was hiding in a feild! but i just dont need this ticket i cant afford it and am trying to keep a clean record

I fight every ticket regardless of how guilty I am. And I don't think I've ever paid the full fine amount, but I'm not a cop

 

I can't speak for other jurisdictions, but here in Texas errors on tickets such as time/age aren't usually dismissed. The time he wrote might be the time that was on his watch/computer/car stereo/etc and may be different than yours. 4 minutes isn't much difference. Heck, right now the time on my watch and computer are 2 minutes different.

In Texas your birthdate is on the license, but not your age.....welllllll b/c as the years go by your age changes . When we write a tickets there is a place for name/address/etc and AGE. Welllll, that make us have to calculate and many of us aren't mathematicians. As a patrol supervisor I review all my guys tickets for accuracy and see many times that the age and DOB don't add up. Here in Texas it's no big deal and not cause for dismissal.

Also I have come across many tickets that aren't signed. Sometimes the officer just forgets and sometimes the violator just refuses. Again, in most cases, not something that gets dismissed.

Usually what causes a tickets to be dismissed are incorrect locations of the violation and/or how the complaint is written (most common). The way our municipal courts work is that after a ticket is written, it goes downtown where a clerk types up an actual complaint (EX: Joe Blow vs. City of XXXXXXX.....) MANY MANY MANY TIMES the complaints are wrong. An example and common dismissal is for running a stop sign. We have several stop sign complaints such as running a stop sign at a crosswalk, running a stop sign at a stop line, running a stop sign - no markings and etc...The errors come when the clerk types up the complaint and if it differs from what the officer intended. Sometimes clerks get lazy and don't look for the crosswalk/stop line/no marking and sometimes the officer doesn't note it. The clerk then just decides which one they think fits. Thats why a lot of people pay lawyers to handle their tickets. Traffic lawyers deal with this everyday and know what errors to look for.

Also, just b/c there is an error doesn't mean is dimissed and gone forever. The officer still has the option to refile the ticket with the needed corrections. Usually the officers just say screw it and let it get dismissed, but to refile it is still an option. In 14.5 yrs I've never refiled a ticket.

Like a previous post said...always go to court! The officer may not show up and in most cases even if you are found guilty the fine is less..good luck!!!

I just re-read your post... It said he didn't fill in the date. What date? The date of your court date or the date of running the stop sign? If it's the date of the alleged violation you have a very good chance it will be dimissed!! There's little chance he is going to remember the date x number of months later when you have your trial and even if he does it doesn't look good. A good lawyer will bring this up and I don't think an officer will want to go to trial on this.

 

where it has the thing saying i accepted the ticket under it has a box with date, and another with signature of defendant, both blank

 

is there any date written on the ticket as to the actual night he pulled you over?

 

yes but the day and date dont match date 10-30-09 (friday) day on ticket tues or thurs (the 29th)


where i am supposed to sighn and have the date, nothingg,xed out

Just take defensive driving if you haven't within the past year. Insurance 10% deduction & clean record. You can take it online at home when it's convenient to you.

 

hmm. if he got the wrong date of the ticket you might have a chance. not sure how it is there, but i dont think you have to sign the ticket in wv. but then again you may have to, not sure haha. heck fight it anyway, you might win you might lose, either way at least you fought it and tried.

I wouldn't hope to get it thrown out on anything that you mentioned.

Call the number on the ticket- That will put you in contact with the correct folks who can tell you the procedure for your area.

 

lol i get that alot, when i have to give my email address out to someone they think i like meteors or something.

hybrid theory is pretty effin a, but nothin beats the good old high school days of workin out on the football team listening to linkin park. well actually we jammed to hybrid theory too. i was pretty pissed when the didnt do PR this year but oh well what can ya do?
