Dealer Deposit Question

    I have a deposit at a dealership for a 3 gen and the salesman i was working with no longer works there but I'm pulling my order from them for many reasons. Since there's nothing on my receipt saying anything regarding refunding or not refunding the deposit in a case of cancelling I'm wondering how difficult it will be to get it back, i know it will be difficult if not impossible but in this case it is worth the hassle...


    Another dealer states it is against the law for them to keep the deposit, does anyone know if it is in the state of Ohio?

    I can't speak for Ohio. But when I placed the deposit on my Tacoma, they specifically told me it was a refundable deposit. None of the Tacomas are truly custom builds and they will be able to sell it to someone else if not to you. I don't suspect it being too difficult to get your deposit returned. You might have to go into the dealer if you made the deposit on a credit card.

    I imagine its refundable unless you sign paperwork stating otherwise. just make sure you had a receipt for it. in my case I used a check for my records :)

    Seems if they breach than it's not a problem.

    Most dealers I've delt with have no problem refunding deposits under any case.

    well, speaking for toronto ontario...
    I had a subaru dealer keep my $1000 deposit when I changed my mind, even after they told me I could get it back.
    As soon as I signed the paper and gave them my credit card, it was gone. Even had a lawyer look at it, subaru was well within legal terms to keep it. Gotta read the fine print.

    well if any dealer asks you to sign paperwork on a deposit, I would suggest laughing and walk out the door.

    yep, would never make that mistake again.

    When I went to the toyota dealer they started with the same shit, I told them right away they aren't getting a penny from me until its test driven and I find out all required info on my part (insurance, financing) Right away told the guy if he doesn't like it I'll just go to a different dealer. He kept being pushy about me getting it right now with a small down payment and I told him no, not until I have a good downpayment saved.

    Tried to tell me, oh but you can put that money on it while paying it off. Ya but still have a big monthly payment. He knows now, when I am ready I will come back, but until then either stop with the pushy bullshit trying to get me to do something I'm not comfortable with or I'll bring my business elsewhere.

    Appreciate the feedback guys.... I did settle on a price but they have completely screwed up the delivery so no date confirmed. The dealership in talking with now is much closer and giving a better deal, so if necessary still worth it.

    I almost ran into the same issue. Asked the dealer before the deposit check was cashed if it was refundable or not. At first they said it wasn't. I gave them a bunch of shit about my having signed anything in writing, locked in the absolute final details, financing, trade value etc. told them I didn't want to be cornered because they knew they were gonna get that 1000 one way or another. Made them put it in writing I could get it back if we could not agree on terms. They low ball my trade I walk, add in extra fees, I walk. Had to make sure to keep the ball in my court for this one. Good luck tho, hopefully they give it back

    I had the same fear when I put down my deposit. I did sign some paperwork that didn't mention whether it was refundable or not. The dealer said it would be refundable for any reason and that they would be able to sell the truck anyway. Regardless, I hand-wrote "deposit refundable if not to customer's satisfaction" and paid with a credit card for additional security.

    I ended up buying from another dealer (I got a better deal AND apparantly my original order never got processed) So now i have to get my refund back. i'll let you know how that goes....

    I put a deposit down on Labor day for a 15' Taco with XSP. Signed all the paper work and put down a $500 deposit. They wanted a $1000, but I told them $500 was enough. The truck wasn't on the lot, it was a dealer trade. My sells guy called me the next day and told me the truck I bought was already sold. He told me I should look into getting a 16'. Long story short, the deal fell through at no fault of my own. They gave me the run around getting me my deposit back. I was told the "check was in the mail", even though I paid using a CC. I did a stop payment/dispute with Wells Fargo. I got a call first part of this week saying I needed to bring my CC to the stealership to get a refund. I work 12 hr shifts andit's hr one way from the ds so I had to wait for a day off to get the refund. Well I told the finance guy, first part of the week I would be seeing him Friday(today) about getting my refund. The finance guy didn't show up for work today. Fortunately, the Sales Manager that helped closed the deal remembered me . He seen me in the lobby waiting and asking question. I told him what was going on. He said he had to talk to the big boss about it.It took me almost 2 months to get my refund back. I will never do business with that place.

    The only way I put a deposit down was with a Credit Card and buyer's order with the DUE amount clear and signed by both parties. If my truck came as noted in the buyer's order and I refused it "just because" I would have forfeited my deposit.

    On the other hand the dealer could not raise the price even though the truck already had the "$1295 dealer pack" on it such as tint, (which I would have paid for) the ding and key replacement for a year, Pin strips (I removed) Nitrogen,and a few oil changes,

    Unfortunately I couldn't finalize mine other than the truck price since it was gonna be a few weeks and they can't hold the trade value. Otherwise I would've done the same. I already made it clear I did not want any extras added in there. No fees no upgrades no floor mats or other dumb shit because I won't pay for it. My last floor mats sat in my garage from day one

    I'm guessing if nothing was signed and no firm date of delivery it's an easy refund.

    The credit card deposit plan is interesting...I guess you could dispute the charge.

    You'll have to update us with how it ends up.

    I actually ordered two new tacomas through two different dealers,two weeks apart. The first once charged me for things they shouldnt have. So I ordered it through another dealer. Got my deposit back. They will sell it to someone else in 24 hours at full price so they wernt worried about it.

    My dealer sales manager told me he's "never NOT refunded someone's deposit, especially if an unexpected financial burden came up".

    I'm not planning on asking for it back, but I would hope he kept his word.

    Made the phone call today on my way home from the "better" dealer and he immediately said no problem and I should receive a check in the mail in a week. Problem solved. I believe it is illegal not to unless you withheld them from selling it to someone else such as one built delivered and they held it for you.
