Let a friend from work borrow the truck...

Weird. Because when I spoke to his Insurance company, they had it all taken care of and everything. Unless he really told them that he hit my car and that's how they are "treating" it. Either way, as far as I know everything is taken care of. His Insurance is taking care of it all and already did as fart as setting up the repair, rental, all of that.

His insurance is taking care of it. He called and filled a claim and got the ball rolling, and when I spoke to the person there that was handling it they set everything up. All I had to do was go to one of the local body shops they work with, to get an appraisal even though I had already gone to a different one. The reason I had to go to one of their "own" was I'm sure, because they "trust" their prices. Not to mention the added convenience of having that same shop to the work. The insurance will pay them directly, as opposed to me going to a shop they don't partner with, then sending me a check to pay for it, which would take long I'm sure because they would dispute the prices and who knows how long that would take.

Even though other people have said differently, this is what is going on in my case. His insurance is taking care of it. Maybe he filled the claim as he hit my car, maybe he was upfront with them about it and somehow they covered it even though they weren't supposed to, not really sure. All I know is that they are covering it and handling all of the charges (labor, rental, etc).

 

In CA, whether or not the insurance follows the driver or vehicle depends on the situation.

Since this is a liability claim and not collision, the insurance follows the driver.

The claim could be filed with the OP's carrier or the drivers carrier.

If the driver he lended his vehicle to was at-fault and the OP went through his own carrier, they would most likely subrogate the loss.

 

Maybe it's the same type of situation here in CT. That would seem logical in my situation. Thanks for the bit of info!

 

It depends greatly on how the policy reads and who the carrier considers a "Permissive User".

If could depend on whether it was a one time deal or whether the vehicle was furnished for regular use.

It gets hairy once you start talking policy language, but it's not unusual for the drivers policy to cover the loss.

 

Seems like hairy isn't even the word... but yeah, messy for sure.

 

I think the important thing to remember is that in CA, the top three things they rate for are length of time driving, driver experience (your tickets/accidents) and annual mileage. Even if your insurance did cover the loss, they couldn't rate you for it (increase your premium). It's not your accident.

Not sure if it's the same in CT, but I just read a few articles on the CT DOI and it appears the accident would follow the driver.

Call Skrips in Prospect, CT. They are one of the best around and they know how to handle insurance companies. The owner is very involved in CT legislative issues that impact the auto body and insurance industry. They do phenomenal work and I personally know several car dealers that exclusively use him. He fixed my wife's Subaru Forester when it was rear ended by a texter. The insurance company was trying to cut costs in parts and rental and they took care of it. They aren't too far away maybe 30 minutes from you.

 

ouch, well as long as it get's repaired to like new condition on his dollar i'd be okay with that, no need to kill the guy. LOL

 

Any time you let somebody borrow something, truck, gun, sewing machine, girlfriend. It may come back f'ed. Risk you take.

True. Never thought about that. Figured he'd be extra careful since he was borrowing it. But oh, shit happens and it happened to me. Lesson learned.

 

no problem.. only time I let my family members use it if they don't want to spend a retnal from airport,, or I cant drive for some reason.. the sign papers and fees to scare off the others or friends to use my truck..
