    That is, sadly, legal. I'd wager if you had an employee handbook there would be some notation in there about them doing that. I doubt an attorney would be able to help.

    Though not the only issue, in part this is because the tips are paid to your employer and he then disseminates the funds, but he's under no legal oblation to do that if he isn't paying you as a tipped employee - hence his payout at minimum wage.

    I'm seeking legal counsel to figure out exactly what my position is. If I'm fucked, oh well at least I tried. Nothing illegal about me doing what I can to get them audited and health inspected if all else fails:devil: As a former employee I am not liable for health code violations committed while I worked there, yet I can provide testimony on the violations that regularly take place somewhere that I have worked:) See you all in hell!!!!!!

    Gavin, I had that happen to me about twenty years ago. Meefzah is right, that is the law. Albeit a crummy one. I had to go through the federal bureau of wages and labor in order to get my pay for my last two weeks of employment. It took almost two years for them to force the employer to pay me for my hours worked at minimum wage (my rate was double minimum wage). When I went to the bureau of wages and labor, there was only one guy assigned to the entire county, thus the reason it took two years. He was well aware of this employers shenanigans and he informed me that I was not the first to file a complaint. He informed me of the law and told me how long it would take to get my money. I did it anyway just on principal. If your employer did this, its because he lacks morals to do the right thing. You might have different results, but I think most people don't follow through with the process, the employer knows this, and does it because they can. Good luck, keep us posted.
