    Did the cops check their phone? I would guess that the driver was texting, or browsing the web. Who the hell runs straight through an intersection in the middle of the day, and isn't drunk?

    It was about 7:30 am and she was in her bathrobe and there was a passenger as well may have been to early for her but I don't know. I never even talked to her, she was on one side of the road I was on the other in these times I felt it was better not to lose my temper. There were 2 cop one at a time both ask me to describe the accident while the other would talked to her. Never even heard her side of the story till her insurance company called. After giving them my statement they said well I guess we are paying for all of it. It had been raining and according to them she claims to have slid into the intersection while trying to stop. I was not worried there was a witness that saw her run the red light.

    "You may also want to ask the insurance company (hers or yours not sure) about decreased value compensation or whatever they call it since now your vehicle has been wrecked as far as any future buyer is concerned down the road."
    They will not give you anything for this if you sign off on the property damage part of the claim. I suggest lawyer. It is a night and day difference in insurance company experience if a lawyer is your first/second call.

    And they will lie later and say you did it.
    After using the lawyer for my last claim, I will never deal with insurance companies again. We were stopped in traffic, clear dry day, on an uphill slope and was rear ended. Later they told the cops that we suddenly braked and they could not stop. She was on the phone, but did not matter.

    Adjuster already know I want loss of value to be estimated after all repairsare complete. Haven't sign anything yet except for the shop to work on my truck, which the lease form was from my insurance before the other driver took over.

    Well the ATRAC is not working went on Friday found some area that needed repaint and test drove it in the shop lot. Test all the drive system and ATRAC would not stay on and the brakes were acting funny so the body shop sent my truck to their brake shop and they said ABS sensor was not working right may likely be damaged(add $2500 more to the damage). Now my truck is back at the dealership for them to replace the sensor and check everything else. One month to the day from the accident don't want to rush the repair but really miss my truck and ready to go offroad again.

    That stinks man...

    I am still waiting on a frame for mine. It's been 2 months and Toyota is saying it will be another 10-20 days before the dealership even sees the new frame.

    Picked up my truck late Friday 32 day after the accident from Gerber they did a really good job too. Went for a long ride yesterday no wobble or sound at speeds up to 75 mph and went for a short test of the 4 wheel drive in a safe area just in case. Took it back out this morning for a better test on some good beach sand and surrounding area with everything working. They did a really great job of matching the paint as you can see everything from the passenger door to the bumper is new except for the mud flap(that I had just cut down before the accident) it was the only thing on that panel not hit. They were even able to get the flecks in the paint match better than the original on the bumper. Glad to have my ride back thanks for all the support.

    Thanks I was hoping I was not going to be stuck with a truck of different colors. For years I wondered why I was paying for insurance, now I know 1st accident in 27 years of driving. Insurance because you can't always avoid stupid people even if you try.
