No, it has not. However, when the owner says point blank, the first time he talks to my wife, that he can't keep his dog chained up, that is a red flag.

He gets one chance if that dog gets loose and is seen on my property. It won't have a second. I know some will disagree with this, but to be frank, I don't care. It is my family to protect.

I get where you guys are coming from with the protection standpoint. The thing I don't get is the kill it mentality. Maybe it's just me, but it seems that one could take more appropriate actions and without ever meeting the dog, how would you know it's temperament?

Go to page 77 and read section 5. You can go to their GIS Mapping system:
    http://guthrie.villagis.net/
to look up your address. There is a tab to show what your local zoning is; chances are its residential of some sort. In those bylaws in the original link, there is a table on page 42 that shows what your building setbacks are. If that trailer is on blocks, it is going to be considered a building and will have to meet those requirements.

Temperament is not being called into question. Mean or docile, I'm not having stray dogs wander onto my property, posing a risk to my family. I know there are good dogs, and there are bad dogs. And, there are good dogs that flip a switch and kill. It happens. Read the news. I'm sure you've heard. I'm just not going to deal with it.

Plus, I will be having 15 or so chickens free ranging on my land next spring, and I don't want to deal with them disappearing because of a loose dog.

The order of "appropriate action" will be notifying the owner if it gets loose and comes onto my property a first time, and ending the issue if it happens again.

We won't see eye to eye on this, and that's fine.

Regarding shooting the dog, if you dont care that it is intrinsically wrong to do this without provocation (i.e. dog is threatening you or your family), please consider that it is illegal in many areas. I live in state that allows hunting deer with dogs, so for a couple of months every year we have hound dogs flushing deer and other wildlife off of our 6 acre wooded property. We cant have our dogs or cats out, or let the chickens free roam, because they come right through the yard. Cant do a thing about it.

And regarding the mobile home, make sure that the owner is obtaining the proper permits. One of these will be a permit to put in a well and septic system (assuming there is no public water or sewer). Many times the location of the house or mobile home will be determined by where the septic system will be placed on the lot, depending on soil and surface topography. The current location of the mobile home might be temporary until they figure out where the septic system is going to go. It is best to find out from the owner what his/her plans are before going straight to local government.

Well, county clerk replied with the following: "In the unincorporated areas of Logan County, areas outside of city limits, there are no building, zoning, or planning codes or inspections. The county has no authority in the situation you described. I don't know if there are any state regulations that may govern this, such as the Dept. of Environmental Quality or Dept. of Health." She asked for my cross streets to give me the information of my commissioner for the district. (I already know...but I'll get confirmation)

So...going to wait and see if they have any course of action with this thing. And I'm going to talk to the owner if I ever get a chance, and ask politely if they can move it some.

My wife and I are going to be paying attention to whomever drills a well or puts in septic, to keep an eye out for any shady business going on.

This is a mobile home and in Oklahoma. Problem should be resolved next Spring!

If there's no legal recourse, several bright security lights shining right on the trailer every single night, all night long will be annoying. Hey, you're just illuminating your own property, right? They don't like it, they can move... plenty of room to do that.

Tall fence will help, but they're expensive. Trees and bushes take time to grow. I'd also suggest loud music early in the mornings... preferably in a language they do not speak. And if that dog wanders into to your land, shoot it dead first time. You're within your legal rights if it's "attacking" and you "feel threatened". Take a stance, make a clear point.

Wow, never heard of a county not having zoning/planning or building ordinances!! Well, a quick internet search indicates the the state health department oversees new construction and enforces the statewide building code. The dept of environmental quality issues septic permits. Like I said, talk to the owner first and in a friendly way find out what is plans are. If he has no intentions of obtaining the proper permits, call the regional health dept and DEQ offices and file a complaint.

He'll need permits for well water and septic, which I believe will be hard to get with an oil tank battery 150-200 feet from the mobile home. Especially since this will be a "new" dwelling that cannot be grandfathered in.

Why not just do the Christian thing and get your church together to clean up the property and fix the trailer? The guy must be hurting if he is willing to move into that piece of junk with 3 foster kids and a dog.
It also sounds like there was already bad blood between the landlord and your other neighbour. Why else would he have jacked up the price for the neighbour but be willing to do a "rent to own" for someone else?

These people are going to be your neighbours (probably long term if they are intending on owning). You want them on-side. Not 3 thugs screwing with you every chance they get.

The trailer is beyond fixing, just from the appearance of the outside. It would cost more in repairs than it would be to replace the thing. I'm not going to get into a guilt trip by being called out for being a Christian for this. I'm not going to start getting into a bunch of philosophical and philanthropic discussions over this. The current property owner has used this piece of land as his scrap yard up until this point. It is not up to me to clean it up.

I understand this guy might be in a hard way, but I can guarantee you there are better, and cheaper, options out there than renting to own from this guy. Especially with the quality of trailer he is willing to "rent out" for someone in a possibly financially burdened position. In this type of situation, I would hope the soon to be "tenant" would hold out some standards for quality of living for himself and his family, and hold his landlord liable for the trailer's conditions.

If that happens to not be the case, I will look into the methods described above into possible courses of action.
