property and right of ways question???

    getting there....
    ok...the house we bought is on 4.9 acres.....in the city, and i bow hunt it.....as i havent found any laws stating that you cant bow hunt in city limits.

    the property has power lines running thru a part of it......and i know that duke power has the right of way for it...although its still considered my property.....but no one else should have the right to it...right?? and i mean like people riding on 4 wheelers......asshats messed up my hunt today:mad:. how do you go about putting up no trespassing sighn in a situation like this?

    That sucks.... I don't believe that anyone but the power company has rights to it, but it's a tough thing for you to enforce. I'm sure youe're not allowed to put up anything more than signs (like a gate). Check your local laws and a phone call to the power company could never hurt!

    yeah...im gonna put up some signs, at least where they were riding the 4 wheelers thru at. reckon i'll make a phone call as well.....cause that aint kosher,especially when im out bow hunting.

    well man.....we had been looking at houses for about a year....and we finally lucked out here with this one. the house/property has been vacant for about 4 years.......hopefully, the people that saw me today wont bring their 4 wheelers back on it.

    Yeah...I'd call the power company- You might be able to put a gate up for two locks....One lock you have the key to and one lock the service guys have the key to in order to keep it secure....but I'm sure they have more insight for you.

    Or start stringing piano wire wire about 5 feet off the ground....o_O

    i doubt i'd be able to put a gate up, as the power line goes off my property as well.....just hopefully, if i put signs up.....they will stay away.

    i say call the power company and ask if you can put a gate up but give them one key and keep one key for yourself. then they can get in and you can but nobody else. i dont think they would have a problem with that...

    Sorry to hear that Will. Start kindly approaching each person that crosses your property and inform them you now own the property. Since it has been dormant a while, people have laid their claims. As they realize you own it now and don't want people crossing your property, over time they will get the hint and get tired of you harassing them. I speak this from experience.

    Also do like others said above and call the power company and see what they will allow you to do.

    Yes it will be a learning curve for the folks who have for the last 4 years doing what the want.

    My last home had deeded easements for both a water line and a power company. Folks before me were renters and did not care and let people go where ever they wanted ie. fishing spot out back & atvs. Other neighbors also interpreted the easements as rights of way. I went to my personal attorney about it, and there are differences, at least in Vermont, with easements vs. rights of way. Easements being for a specific purpose, RoW more broad in their scope.

    It took a bit for folks to understand things had changed, ie. posting, I planted these wild thorny bushes, much cheaper than a gate and less costly... it stopped most but there is always a few bad that push the issue.

    I don't know if I helped you at all and wish you luck getting it squared away Will, man, you work hard to get your place & all set up for hunting too. Calling the power company is free and a great place to start...also those thorny bushes ouch! :)

    thanks Ben......i put up 2 posted signs this am...and am checking the city ordinance as far as bowhunting in the city.

    Judy......you are very helpful.:) i know that where it is....its duke powers right of way....not an easement for anyone else, so im gonna call duke power. i may go barbed wire tho.:D

    Here in Indiana, we must have posted signs to warrant trespassing. So that is a very good first step you made more than likely. Not sure of your laws on tresspassing, you might want to find that out too. And tell the people when you talk to them to go to the courthouse and get a plat book if they don't know the property lines. I have some other resources too if you need them.

    an ordinance they just passed here..........anyone riding 4 wheelers on any property besides there on...they HAVE to have written permission. with this ordinance.....signs do not have to be put out....but hopefully the ones i put out will let the fols on 4 wheelers know that someone has the property now.

    good idea with the signs. might help keep you from having to approach anyone. With an ordinance na being ion city limits, just might as well call the police if they won't stay off. Just pull all the bait out first.;):D j/k
