    The HOA can make an exception if they want. It seems this man may have earned an exception to the rule. If he is dancing around naked, draped in a flag, that is different, but I don't think you have to worry about that with this man.

    That's right.... the wording doesn't actually say "Big flagpoles are not permitted" lol
    It doesn't have to, but I'm willing to bet it says "no unapproved structures can be built on the property" or something to that effect. Or it says something like "nothing that compromises the aesthetics of the neighborhood can be built." Which in either case he would have to get approval from the association and it's up to their discretion. In the articles I've read more than once it's said that the association denied his requests and he flew it anyway.

    As much as the concept of what is going on here sucks ass...I will agree that a different method of display should be sought if indeed there was written jargon BEFORE he put it up if the asswipes cannot give him an exception so it doesn't get any more retarded than it already is & him lose money on lawyers or lose his damn house because of it.

    Seriously, I believe this is the problem with the U.S. now. There are too many rules, laws and regulations. If somebody wants to fly a flag in their yard then so be it. We should be free to do what we want. If his nieghbor wants to fly a Iranian flag than so be it. Freedom to chose what you want to do. That's what our foudning father's wanted for this country, IMHO.

    I am all for the flag, but if you join a HOA read the rules first. This is not about a flag, its about how the flag is displayed.

    Take down the pole and put it on a flag holder on the house. But make the flag holder 300 feet long and make it a 100 foot by 200 foot flag.

    he should remove the pole from the yard and mount it to the highest GD point on his roof instead

    im wondering if he moved into this neighborhood and joined the HOA or if the neighborhood grew into having a HOA after he moved in

    that could make a difference too

    Wow seriously depressing. Whats wrong with people today? The flag doesnt look pretty..take it down. Screw that. Both my grandfathers who fought in WWII and Korea taught me life isnt pretty but we deal with it and move on. Cant believe that a hoa would have the balls to create an issue out of this.
