    side topic...i understand laws are persay rules...but rules that are not laws are not necessary for free/healthy/safe living

    this is a ridiculous rule that some self important person/group of people decided on and were too self important to see how much this flag means to the Col.

    They themselves can override their own rules...there is just...quite obviously...too much ego within the group

    Perhaps, but this is America. No business/organization should be able to tell someone how or when to fly the flag. This is a nit-picky issue that the HOA brought up.

    If I was him, I'd get a bigger pole and fly a bigger flag.

    I've been subject to HOA rules in the past and I get that... I don't disagree with the fact that there was a rule... I just disagree with the rule.

    What is the flag pole hurting? Because some dimwit doesn't want to look out his or her window and see a pole? Get real.

    My point is that HOA's are OUT OF CONTROL. There was another similar but recent case not to long ago... where a HOA was trying this same stuff with a Marine Veteran because he had the usual Marine stickers on his truck (which by the way weren't excessive).

    It's all BS.

    Facts:
    The flag is great but this is about the poll.
    He signed the HOA agreement agreeing to
    The HOA told him no on the POLL.
    He built the poll anyway.
    Summary
    This is not whether a vet can fly his flag it is whether he can break agreements and build whatever he wants (poll)
    If you want to do whatever you want on your property don’t buy a house with a HOA. It’s that easy.

    +1... He apparently stood up to three Mark IV Tanks with a Bazooka in WWII. I'm guessing he's not very scared of some little 9 biatch HOA Board.

    For conspicuous gallantry and intrepidity at the risk of life above and beyond the call of duty on 23 May 1944, near Carano, Italy. With his platoon heavily engaged during an assault against forces well entrenched on commanding ground, 2d Lt. Barfoot (then Tech. Sgt.) moved off alone upon the enemy left flank. He crawled to the proximity of 1 machinegun nest and made a direct hit on it with a hand grenade, killing 2 and wounding 3 Germans. He continued along the German defense line to another machinegun emplacement, and with his tommygun killed 2 and captured 3 soldiers. Members of another enemy machinegun crew then abandoned their position and gave themselves up to Sgt. Barfoot. Leaving the prisoners for his support squad to pick up, he proceeded to mop up positions in the immediate area, capturing more prisoners and bringing his total count to 17. Later that day, after he had reorganized his men and consolidated the newly captured ground, the enemy launched a fierce armored counterattack directly at his platoon positions. Securing a bazooka, Sgt. Barfoot took up an exposed position directly in front of 3 advancing Mark VI tanks. From a distance of 75 yards his first shot destroyed the track of the leading tank, effectively disabling it, while the other 2 changed direction toward the flank. As the crew of the disabled tank dismounted, Sgt. Barfoot killed 3 of them with his tommygun. He continued onward into enemy terrain and destroyed a recently abandoned German fieldpiece with a demolition charge placed in the breech. While returning to his platoon position, Sgt. Barfoot, though greatly fatigued by his Herculean efforts, assisted 2 of his seriously wounded men 1,700 yards to a position of safety. Sgt. Barfoot's extraordinary heroism, demonstration of magnificent valor, and aggressive determination in the face of pointblank fire are a perpetual inspiration to his fellow soldiers.

    based on this he should be able to pretty much do whatever the hell he wants whenever he wants!

    I say screw the HOA. What authority do they have anyway? The whole basis of their authority is a group of people who abide by the rules they have set forth. If he directly disobeys them, what power do they have? About the only thing they can do is put a lien on the property until the offense is removed. If I were 90 I'd say, "I'll give you the finger, put the damn lien on the property. I'm not gonna sell it before I buy the farm anyway, a$$holes." Then tell my children / next of kin that they may remove the flagpole in order to settle my estate.

    Ok so after reading this thread it seems like people are talking about two things:

    You have the people talking whether the Guy should be able to break his agreement with the HOA.

    And people talking whether the HOA should have allowed him put up the flag pole.

    I think the answer is:
    No and yes it is not that I don't respect him I respect all military personnel
    I also respect my mother and father but I don't believe they have the right to break there agreements.

    Maybe if the flagpole was sneaking off in the night and smashing neighbor's windows, tripping people on the sidewalk, and taking random swings at cars driving by, then I could understand the "need" for it to come down.


    This guy's gonna end up going commando on his HOA.

    And this is exactly why neighborhoods have such rules - to prevent people from trashing up the neighborhoods and bringing the house values down. Having an aesthetically pleasing neighborhood gives good values to your home.

    What exactly is aesthetically pleasing?? Well, that would depend on the past (why rules are set) and the future (how people complain about things).

    Unfortunately - if other people in the neighborhood are going to complain about something, then the HOA would probably step in.

    Afterall.... do we have any pictures of what the mans flagpole looked like, how it was errected, and where it was positioned? It might actually look like total shit....and make the yard looked horrible - regardless if there's a flag hanging on it.
