    You can always tell them look, this gets resolved the way I want it to through you, or through lawyers. Pick which one you want. Honestly, they do really owe you a new truck. That's what you paid for in the first place.

    Glad to hear TMS stepped up and got Koons to make it right. We will never know what transpired to make this deal happen but it doesn't much matter at this point.

    I would NEVER shop at either of these two dealers. But I will definitely own another Toyota. Look forward to the resolution.

    on my many tours of the edison n.j. ford ranger plant (when it was still there) i witnessed many body repairs(from minor scratches to big dents) being done to "new" trucks. i"m absolutley positive that ford isn't the only manufacturer that does this. The bottom line is this: the vehicle has a body/paint warranty that is good for so many miles. if the damage is repaired in a manor that is unsatisfactory it will pose, and show, problems well before that warranty is up. if it doesn't you and whoever else will probably not even know it's there.

    Toyota probably told Koons that it would be less expensive for them in the long run to make you a happy camper. And since Koons is part of causing the problem, Toyota has leverage over them that it does not have with other dealers.

    It is good to hear that things are going your way - finally!

    Haha hopefully I will not have to post any more drama tomorrow. I'm hoping that it really turns out as simple as signing some papers.

    +1 I'm very glad that this deal will leave me with the option to buy from any dealer I want. Koons would probably have kept my business if they had offered this solution the moment I told them I did not want to keep the truck. As it is, even if the end result is acceptable, I'll never be able to separate this experience from this dealership. They'll probably be just as happy to close the deal with me as I am them.

    Thanks! I'm taking the truck to NTB at 7AM tomorrow to get this done and driving to Koons right after that. If I get a 4x4 Sport I'll just be able to get new tires for the FJ rims since I can't swap the stock 17" tires from that truck.

    Yep, I removed everything two weekends ago. PITA.

    Oh...btw the reason I was looking up libel suits was that I was planning to create a website detailing this whole experience and post the site on the sides and back of whatever replacement truck I got. Basically what I learned is that the best defense is the truth, so I would have been ok in that route I think. Glad I don't have to pursue it. I had plenty of friends willing to help create and host the site.

    Ok...I'm a little uneasy but I guess there's nothing to do but wait.

    I turned the truck back in to Koons this afternoon. They showed me photocopies of check requests. One was to TFS for the balance of the loan. The other was to me for the balance of the $24,401 after TFS had been paid off.

    They explained that they would process the check request today and a check would be sent to TFS. They said I should get the title within a week and when I do I can bring the title to Koons. Once I get the title they will hand me the check.

    Does this sound ok? They said I could cancel my insurance and I confirmed that with Progressive so the truck is off my policy. The tags were taken off the truck and I have them. I just need to report it as sold to DMV so I am not charged property taxes past today.

    The only bad thing is that I won't be shopping for a new truck until I have the money in hand.

    Glad to hear everything is clearing up for you. Too bad it took corporate to get things done right. Koons should've stepped up and fixed it in the first place.
    I'll bet you've gone through several bottles of aspirin in the last couple months. Take it easy and post up some pics of the new ride so if I see you on the roads I know whose truck I'm admiring :D

    If they gave you a signed purchase agreement effective today this is ok. Then they are responsible if there is any damage to the truck between now and when they give you the final check. If that paperwork is waiting for when you pick up the final check then you are still the "owner" and responsible for giving them the truck in good condition on the day you make the "sale". If you are still the owner then do not cancel the insurance and get the truck back.

    Also, if you originally bought the truck with a trade-in then they should leave you with a loaner vechicle till the sale is finalized. If you had no trade-in then it would be normal to leave you without a vehicle.

    Did they show you or give you the photocopy of the check request. I would get a copy if you don't have it.

    Glad to hear its all ending on your side. as meentioned above, get a copy of that check and make sure you have a SIGNED sales order from them stating they own the truck now.

    I get the whole feeling uneasy thing. But I think everything will continue to flow smoothly. Your best bet would be to wait to have the check in hand before buying something else. I guess you do not want to count your chickens before your eggs are hatched.

    Cannot wait to see pics of your 2010 TRD Sport.

    I'm sure it will be beautiful.

    Lastly, I am glad at least TMS stepped in and did the right the thing. Bodes well for them.

    I wish I had known this going in. All I signed is an odometer statement and power of attorney for the title docs. They did show me a copy of the two check requests.

    I'll stop by tomorrow after work and get them to produce a purchase agreement.

    EDIT...Hmm...Just called Debra and she says these docs are not necessary and the only document is the transfer of title. I'm calling my insurance company for some clarification. Is there anywhere else I can go to find this requirement? She did say today when I turned the truck in that it would be under their insurance and so I could remove it from mine.

    I called Progressive again and put the truck back on the policy just to be safe. I hadn't reported to DMV that the vehicle was sold yet either. Progressive said that since I called in the change today it was 'In process' and could be cancelled as if nothing was done.

    On the other side of things I'm guessing Koons could not slap tags on it and take it out on the road legally since its still registered to me?

    I found this on DMV's website;
    "Insurance companies notify DMV whenever they cancel, add or write new coverage for a motor vehicle. Therefore, if your insurance company cancels liability coverage on your vehicle because you no longer own it and you don't notify DMV, our records will show that the vehicle is registered in your name but is uninsured. Since it is unlawful to have an uninsured registered vehicle, DMV may suspend your driver's license and vehicle registration privileges."

    There is a $500 uninsured motorist fee in VA. If you have an uninsured vehicle the state charges a $500 fee...sucks hardcore. I'm glad we caught this!

    That was a good catch on your insurance and DMV.

    So in your state you have to pay tax on both vehicles? You do not get any credit for selling the hurricane truck? Up here we only get taxed on the difference if we trade in or sell outright up to 3 months after the sale.

    Are you asking about if I traded the hurricane truck in for a replacement Tacoma? Yes, I would end up paying full tax on both vehicles. I'm going to get the replacement vehicle from another dealer. Even if it was a trade-in transaction done at one dealer, I would still be taxed on the full purchase price of the new truck. I wish I lived in a state where the trade in would deduct from the taxable amount of the new vehicle.

    Property taxes would be pro-rated on the '09 since I didn't have it a full year. The taxes on the '10 would also be prorated to the end of the year. Property tax is $4-something per $100 of assessed value.

    Sales tax on a new vehicle in VA is 3%.
