    Most parking lot accidents are considered private property and the police don't really have any authority or jurisdiction to do anything from my recollection.

    Please expand on what you mean, exactly. Are you inferring that he cannot be cited by the police for a traffic violation?

    Perhaps the biggest difference between an accident on a street and one on private property is that, in some jurisdictions, the police will not write tickets for parking lot accidents. In traffic accidents, when the at-fault driver gets a ticket for something like careless driving, and is found guilty of the careless driving, that traffic ticket verdict can sometimes be used to prove negligence

    I see. Well the attending officer stated that he would not be cited, because he was on private property, however, in his police report, he stated that based on both drivers statements "vehicle 1 backed out of a parking space and struck vehicle 2". In my mind he either did it negligently or intentionally, right? No grey area there for me...

    Must vary by state, I got hit at work this past February and the offending individual was cited. Snowy, untreated parking lot in NY; I was traveling in a lane one direction at ~10mph, oncoming guy chose to cut between cars diagonally across lanes and slammed into my LR door/wheel going damn near 20mph with all 4 locked up. $10k in damage for me, unsure of how his SUV fared.

    All the same, sorry to see that happen to you OP. Hopefully the insurance companies and body shop do right by you.

    Stuff is getting worse out there for sure with people being idiots and not paying attention! I now run dash cams in both vehicles, because of a accident I had awhile back where an old man came in my lane on a side street and knocked my mirror off and broke my side widow. No witnesses so could not prove he came in my lane. I went to Amazon and bought a couple cameras and so far all is good! Just want to be able to prove I was in right next time!

    I know how you feel I already have a scratch on the roof from rocks flying off some guys trailer going down the interstate. Make me sick knowing its there. Does not even have 500 miles.

    I've been in two accidents in the parking lot of fast food joints (neither my fault) and numerous close calls... I avoid fast food places like the plague now (also benefits my belly)

    The police would never respond to a collision in a parking lot where I live. They take hours to respond to non injury accidents on the street. Sounds like the guy that hit you was insured? That's fortunate. Good luck OP.
