Dude with the broken CV axle bitching about dealer not covering it under warranty because of an aftermarket suspension, then posting pics of off roading.

Only reason I could see them not covering it would be because of the aftermarket suspension, but if it happened on a stock suspension then they would have to

    The Magnuson Moss-Warranty Act
The Magnuson-Moss warranty act is a federal law enacted in 1975 that makes it illegal for auto manufacturers (or any manufacturer of consumer products, for that matter) to void a warranty simply because the owner of the vehicle adds an after-market product to a vehicle. The law states that manufacturers have to repair a vehicle problem UNLESS they can prove the problem was caused by an after-market part.

The Magnuson-Moss act also makes it illegal for manufacturers or dealers to require “tie-ins” as a condition of your warranty. Dealers and manufacturers can not require you to service your vehicle at the dealership as a condition of your warranty, nor can they require you to use certain brand name parts for your maintenance or repairs.

They have to prove that the aftermarket part was the cause

its the principle of the situation. in 1975 there was legislation passes for our protection adding aftermarket parts to our vehicles. someone has to stand up for whats right. i can buy a CV axle for less then $200 and install it myself for free. but then the dealership get away with denying a claim because i installed a lift kit.

if time and money were and issue i wouldn't have a 6" BDS lift kit with FOX Coil-over shocks on it now would I. Toyota will end up paying for my lawyer fees. and the dealership will think twice before denying the next guys claim.

Off roading doesn't, but it doesn't help with the CVs. Main issue is the big suspension lift does affect CV angles and wears them out.

I already spoke with the manufacturer (BDS) of the kit. my kit had a transfer case drop bracket installed and they state that all the angles on the axles have not changed from stock angles. they told me toyota is the worst as denying these types of claims.

Smart , I'm glad you checked with BDS and gave feedback. I don't think it should have broke. It Could have been damaged on lift install if it was hyperextended

Not sure we didn't do anything hard core at all. just some trail riding for the most part. the picture of my truck with the back tire off the ground was the biggest obstacles we went through and event that wasn't real bad had it in 4 wheel low never went over 5 miles an hour. it concerns me that the axle broke.I couldn't even tell you when it happened never heard any load pops or bangs when it broke. it may have just been a defective part or weak part. i hope they don't break that easy in the future.

If you didn't install the lift yourself you're not 100% sure what happened , I have done a lot of these lifts on runners and Tacoma's and believe me if you hyperextend the axle and it gets turned wrong or pounded back in it could damage it easy. Blown up Toyota axles is not , Not ! a common thing.

The dealership is not fixing it under warranty so i am going to do it myself. i can buy the part from toyota for $129.99 its a remanufactured one do you think i can trust it or should i spend the 466 bucks to get a new one?

Get the Toyota part , that's what the dealer would do . this was was most likely just a defective part and you had bad luck and they're being jerks. When you pull the axle jack the truck up on that side as high as you can , lower the other side as low as you can you'll lose less fluid. Make sure you lube up the new axle and O-ring where it slides in. Be careful when knocking it in to get that C clip locked make sure the CV is lined up straight and the boots are nice . Removing the original axle can be a pain as well be Careful with that tin dust shield

Thanks! No lift and these are my snow tires, Bridgestone Blizzaks (275 70 R16s).

Random note, I noticed last week that sometime in the month I've owned the truck someone has stolen my spare tire out from under the truck. Has anyone else had that happen or heard of that? Super bummed. On my old 4Runner you couldn't access the slot that lowers the spare unless you had the back hatch open. Apparently on the 2016 Tacomas you can lower the tire without having the tailgate down.

Just a heads up for everyone! I'm going to get some kind of lock for it when I replace the spare.
