Not sure of the law in your state but either way this would be repaired in MA. My vehicle didn't have factory fogs which I later installed and one of them was paid for by the asshole who hit me last year.

Fight the other company like hell on this one. It's a part of your vehicle and should be taken care of.

I do have the extra property on mine but because of my stereo in case it is stolen.

If the at fault party's insurance is being difficult and not willing to make you whole, you can always take the at fault party to small claims court for damages that their insurance is not covering. It will also probably light a fire under the at fault party's ass, and they will start putting pressure on their insurance company to get this claim settled.

If you were at fault, you'd need to have declared the addition with your insurance company. Of course, they'd adjust your rates accordingly.

OTOH, if it isn't your fault, the at-fault driver's insurance should cover it as property damage. I wouldn't agree to settling the claim until it is repaired or replaced. Shit, when my Taco was rear-ended Geico was all worried about having to re-bedline the truck. Claims adjustor didn't say they wouldn't, just that he wouldn't be able to sign off on it until the body shop made a determination.

Ask them to point out where you signed up for such an agreement.

Again, what does your policy say? It is the contract between your and your insurer. Your agent may not fully understand it or he may even lie to you to make his own day easier. You need to read read your policy and know what it says. The TW chorus is no substitute for reading and comprehding your contract with your own insurer. If you are screwed under your own contract and they won't help then its you against the other driver and their insurance company. One way or another if the other driver was actually at fault, you have a right to be made whole for whatever you lost. It may take a call or letter to your State's insurance commissioner and/or a trip to small claims court.

That's bullshit. I got rear-ended once on my way home from the grocery store and I got my ice cream and steaks covered by the other driver's insurance.

Since you are not at fault it should be covered whether or not accessories are covered under your policy. He damaged your property with his vehicle period. They are trying to pull one over on you.

I have AAA and had to add insurance to cover my Snug Top Shell, otherwise it would not be covered.

There is a reason lawyers exist. OP just found out why.

Ever wonder why people claim physical long term injuries after a T/A? It's because they got such a pain in their ass dealing with insurance companies. One of the reasons ''The Incredibles'' is still one of my favorite movies, they did such a great job with the insurance wonk and his ''never pay a legit claim'' attitude.

Yup, as others have stated most insurance companies you have to give them a list of add-ons/accessories so they will be insured or they won't cover them. Now if it was the other persons fault their insurance should pay, that is IF they have insurance

I had the issue with a car several years that was hit in the right front side and broke the wheel. Since they were aftermarket wheels the insurance company would only pay for a stock wheel.

Check your home owners insurance. It may cover it. If not I'd be in small claims court suing the other driver.

Not really sure why your insurance company would be involved in any repairs. If it was the other drivers fault then, their insurance should be eating it all up. I call bullshit too. I would honestly go to small claims court even though it'll most likely cost more than a bed cover. But in this case, it's about principle, not money.

Insurance companies are the biggest weasels ever.

If they are at fault they are responsible for your property damages, they don't get to pick and choose which ones.
Doesn't your neck hurt?? You should see an attorney and a doctor of chiropractic medicine. They usually will wave your percentage of the costs if you use their services. Make em pay, they will wish they covered your bed cover.

State Farm is screwing you. I carry coverage for accessories on my policy. If the cover was on the truck at the time of the wreck they have to replace it. Do not settle until they do.

Contact your state insurance commission, I'm not sure how Ky. works but in Ohio the at fault party would have to cover all your losses including the bed cover.
Diffinately call B.S. on State Farm also your agent, I'd dump him after alls settled.

I'd have told my agent that I pay them to work for me. Then again I pay for insurance with a $0 deductible which covers the accessories on my vehicle - camper shell, roof rack, etc...

Are you both covered by State Farm? I ran into this problem in a very serious accident many years ago. We both had the same insurer (State Farm). It was really tough to get anything. I pretty much ate crow (young and dumb), but my passenger went to court looking for blood and got paid. My passenger was legitimately almost killed and has severe physical scarring for life, so I was in full support of her action.
