    Those do not apply to a used vehicle in any state. So, No you don't have lemon laws in this case.

    I don't think a 10 year old qualifies as Toyota Certified...

    So you buy a used truck, go to pick it up and look at it. Decide yeah, it's good I'm going to buy it. Then as your trying to leave the truck won't move. You allow a sales manager to beat it up to get it to move and then just drive off into the sunset, only to get more aggravated on the way home and afterwards when you take the truck to a shop you trust?

    1) why didn't you throughly go over the truck yourself? If you smelled the ciggeratte smell on the ride home and then noticed burn marks later there is no reason you didn't see the burn marks then, even if they tried to mask the smell. So that's all on you

    2) You try to leave and the truck won't move. I understand not everyone is a mechanic but that's a huge red flag. Any sales person or manager is going to say oh yeah there's nothing wrong or down play the issue. Especially since you live out of state. Once you out that door they figure they will never see you again. What you should of done is took it for a test ride and stopped at an independent shop. Asked or paid them to look over it quick and get their honest opinion of it or what it needs. So again that is on you.

    3) What does Toyota corporate have to do with this sale? It's a used truck. It's not certified either. There for they have nothing to do with this transaction. Dealers are all independent. Your extremely lucky they helped you out. I'm guessing the only reason is because your loyal to their brand, and/or they just did it out of courtesy to please you so you leave them alone.

    I will agree they should have a disclosure of what the truck needs that they didn't do. We do this at our auto group. The techs go through the vehicle and list everything the vehicle needs. Sales will do some of the work/all depending on what it needs, how old or much they are asking, ect. However even though they didn't disclose this information, you still need to be an informed buyer. They didn't hold a gun to your head and make you sign the paperwork. Sure they might of sleazed their way through the sale, but you really can only blame yourself. If you've purchased many used vehicles in the past, you of all people should know this and have been well informed. If you were a 18 year old buying his first vehicle by yourself, and didn't know any better I might have a little more compassion for you.

    Unless it passed an inspection and they told you everything passed, it's on you. Unless I missed it, you didn't mention any discussions regarding the vehicle condition, brake pad levels, filters changed, etc. If you didn't look under the truck before buying it, take it for a decent test drive or even notice the cigarette burns in the interior.... you're getting off relatively easy. Moral of the story isn't extended warranty - it's due diligence.

    I always find the responses to these type of experiences interesting. It seems as though some forum readers want to jump all over the OP and find a problem only with what he has done or not done. Others want to jump all over the dealership because all dealerships and all people who work for dealerships are crooks. After working in a dealership for 2 years, 1.5 in sales and 6 months as a service advisor I can tell you that I met assholes every day, some who worked for the dealership, some who owned the dealership and many of which were customers of the dealership. I would guess from his responses that the OP is well aware of his mistakes in not checking to make sure that what was promised was delivered. If he had to do it all over again I suspect he would have done things much differently. That does not absolve the dealership of its responsibility to give an honest account of the condition of the vehicle. Someone at the dealership messed up badly. If the purchase discussion was going on past a couple of days then they had plenty of time to check out the truck to figure out what they needed to do in order to either retail or wholesale the truck. Retail means they offer a warranty and wholesale means inspect it closely because once the paperwork is signed and it is off the lot then you own it and any problems that came with it. Any work done on the truck to bring it up to minimum acceptable condition would be added to the price the truck was purchased for. It looks like management had two choices, own up to the fact that the truck was misrepresented or blame the buyer. Most used vehicles come with a 3 month, 3000 mile basic warranty. Offering $500 with a letter from a lawyer asking for a signature absolving them of liability is a cheap way to get out of the problem and indicates an admission of guilt as far as I am concerned. My worthless opinion is that both sides made mistakes. The buyer in not checking the vehicle and trusting the dealership and the dealership in not preparing the vehicle correctly then trying to cover up their mistakes. No matter how you look at it, it is one big avoidable mess. Hope everything works out for you OP.

    Eh, due to the lack of the buyer paying for a PPI, these issues that came up are at his expense. If he doesn't have an inspection sheet, he doesn't have a leg to stand on to prove what is/was bad on the vehicle at the time he drove off the lot. Who is to say that this damage didn't occur during their travels home? I not saying it did but it's always a possibility.

    To me, any car with ~100k miles is going to need some sort of maintenance. Unless you're buying it from someone that you know has taken care of it or they have the service records to prove its maintenance. Always plan to spend some towards it. Thankfully, repairs are reasonable on Toyotas.

    Dammit OP I was typing when you deleted this! :( I just had one question: Surely you test drove the truck and the wheel didn't lock up then? It only locked up after you test drove, then paid your hard earned money? Just curious.
