    If you're without your vehicle for 30 days the first 12 months that should qualify under lemon law, at least it does in my state.

    I don't know how there's any case for the lawyer though. It's not like Toyota isn't doing anything. If they were just sitting on their hands, or tell us they can't help us, perhaps a lawyer route could be considered. In my case, prior to the issue which took them 1 month to fix, the truck was back at the shop 3 times, (while turning the wheel as you go up a ramp you'd hear a gear grinding noise, loose bolts, truck jerking and bucking etc.). I don't know..

    Well, a month was an exaggeration. They kept it for 27 days. In the end when they returned the truck fixed, the reason they told me was parts took time to arrive being a new model truck. Whatever it was, they didn't fix it correctly, because it's still leaking, and broke down on the freeway. The rear diff was smoking when I got out of the truck. They gave me a corolla car. So that's what I am driving around the past few days.. still waiting to hear back from the service center about my truck.

    I believe it's a combined 30 days without vehicle in the first year. Sounds like you are well on your way to that. Check the lemon law for your state.

    The reason I suggest a lawyer is because they know the specifics of lemon laws on your state. They can best guide you of a reasonable timeframe to give them to fix it or lemon it. It is usually a combined amount of time in the shop for the same problem.

    I concur with ridin' dirty. An attorney will help with the letter to Toyota at the least. At the most, an attorney can get you the best result.

    These guys are right it doesn't have anything to with Toyota doing something or not for you. The truck is a lemon because it's brand new and you've been without it for nearly a month cumulatively since you've owned it..? probably more than that now with the second failure

    This is all true, and I know that. If anyone, I know I have the best case and reason above all in this 3rd gen forum to reach out to an attorney. I know.
    My chief reason for not going the attorney route is in the end, even if they gave me two of the most expensive 2017 tacomas or even a Tundra, I don't gain anything. I am not winning. Yes, I might get two brand new trucks instead of one. But in my eyes I am not winning. I am not sure how long you've had your truck, but @smitty99 I thought you among all the rest TW'ers here would have agreed with me on this. Unless Toyota does some magic update to the transmission and engine, these trucks are just not worth all the hype. I really wish I had test driven my tacoma over a period of few days multiple times, even if that made me look like a dork and the salesperson angry at me. Had I done so, I probably would have caught this engine and transmission just don't go along together. No matter what everybody in this forum say how much they love their tacoma, I know this engine sucks. It has absolutely no usable torque, and it's towing is really poor and a drag. So you see, even if I get a brand new 2017 truck, it's still the same crappy engine and its transmission, no change there. And Tundras on the other hand gives single digit gas mileage. There is no win here. I could tell you one thing for certain... my next truck wouldn't be a Toyota.

    The lemon law would force Toyota to basically refund your purchase minus ttl, I have a coworker who had major trouble with Kia, they lemon lawed it and Kia had to eat it, and they bought something else, I think a honda. It's not a matter of winning, it's getting what you paid for in good working condition, which yours is not. Also, this is also a major safety issue, which you are very well aware of.

    I just want you to have a safe, reliable truck that you work hard to pay for.

    Yep. My truck has spend more time at the service center, than it has been with me since purchase. I know that for sure. I checked. All I ever wanted was a truck to enjoy : (.. instead I get this dumb corolla.

    I know what you mean, I wanted a truck since I was a teen, and this is my first truck and new vehicle, and it is disappointing to have issues on a brand new truck. This is why you should seriously consider a lawyer and lemon law, you don't want to be stuck with it and not be able to use it or sell it later.

    I traded in a 2015 with 17,000 miles and they depreciated it way less than $5000 from what I had paid 18 months earlier. Your dealer is screwing you on the trade in value. If you really want to trade it I would take it somewhere else to try to get a better deal.

    I ended up getting a '16 Tacoma SR5. For the most part I'm happy. It does have the transmission issue. So I do the ECT thing, which helps, but then I get a vibration around 60 MPH (non tire). My dealer set me up on the Platinum warranty, they also cover the power train for as long as I own the truck. So, as long as it stays together, I'll hang with it.

    My truck broke down on the freeway., engine cut off, won't start back up.. the diff was leaking and smoking.

    This happened to me in Chicago in a rental...a GMC SUV...."REDUCED ENGINE POWER" light came on...traffic was cooking along at 75MPH and we had to get over 3 lanes to pull-over. Absolutely ridiculous that the manufacturers allow that to happen. PS....had to change my shorts.

    I was able to get them to buy back my truck, but Toyota, is stubborn, and it will take awhile to get any help, by the time help will come if your lucky the 18 modle will be out, and 17s are just now rolling out and they may have the same issues as the 16s. And because of this reason i went with the 4runner, bit if you have any questions you can PM me

    Yea i can it will be harder for him because of the massive amount of complaints about the 16s but still possible. They will still try the same tricks
