Does $400 sound right to replace a trans pan seal and replace fluid? Service writer said three hours labor. Independent shop. There's some slight seepage, but no dripping.

Forgot to mention, it's an automatic.

Well it's about $50 worth of parts, and that's if they use an OEM gasket and do a complete flush of your transmission, so their shop rate is $115/hour? Seems pretty high.
It's not a difficult job, if you have the means and work space I would suggest you do it yourself.

While I was waiting, I overheard the service writer say that their labor rate is 105 per hour. They said it was a liquid gasket.

The OEM calls for black FIPG (form in place gasket) to be used for trans gasket. Honestly it's a very messy job and Toyota fluid is hella expensive. You can use the cheapest of the cheap DexIII and do it yourself for less than $100, or pay for the convenience.
