There are a variety of dates, terms and conditions out there relating to various vehicles and their fixes. I'm clueless what yours may or may not qualify for. It's not really as much a dealer choice as it is a Toyota choice. Toyota themselves has the right to decline if your truck doesn't meet the conditions for remedy.

IMHO, at the very least, the selling dealership owes you a full refund, if you want out of the truck. And they need to come and get it, not you take it to them, as well as reimburse any other expenses, like TTT, etc.

They sold you an unsafe (failed inspection) vehicle. If a couple of phone calls don't get cooperation, a dime store lawyer and a newspaper reporter can make enough noise to get your situation resolved. Headlines of a dealership behaving this way can kill their business, and they know it.

All this is 'unless' you signed some kind of papers stating 'as is', and maybe with a well below market price. Like being wholesaled or taken to auction.

If you did a regular purchase and got the normal minimal 30 day warranty, you should move quickly, because that's part of your 'evidence' that they purportedly inspected it enough to warranty it.

I know none of that is what you asked. I'm offering it up as ideas because I'm skeptical Toyota corporate is gonna play. :fingerscrossed:

I still think I made the right decision to keep my Truck rather then sell it back

I would have more then likely bought another one a little newer with the same issues.

This way it has my Life Time warranty

I can`t see how the original Selling Dealer did not know of the condition of the frame .

Unless it was some weasel of a salesperson new to Toyota unaware of the frame problems took the truck in trade and turned it real quick

What happens if you have a drop bracket 6" lift and the frame fails. Are the failing on rust or is there a certain criteria of frames that have just failed because of bad design or welds?

    Pretty much stock right now
As far as I know it's only on rust perforation of the frame in any one of about 12 specific locations. Don't know about the lift. Mine was/is only about 1.5", which is hardly noticeable. (I moved my lift to my '03 when I decided to sell my '01)

After 280k miles and almost 14 years, my first gen has no sounds on the inside. One of the cats is bad and sounds a bit weird from the outside but other than that there are no problems. It was taken care of well and theres not a spot of rust on the frame. Wouldn't trade it for a free '17 if offered...

Do you think years down the road the 2nd generation will be to the 3rd generation, what the 1st generation is to the 2nd generation?

You mean usually regarded as superior in most ways and loads cheaper? Yes, although I dont really have anything against the third gens except the grille area is kinda ugly. The later 2nd gens were the best looking. I still think as far as overall build quality goes the first gens will never be outdone. Some of these newer cars done feel like they can go 300,000 miles without one of the fancy gizmos failing...

Just curious, what changes did they make to the later 2nd generation, that is different than the early 2nd generation?

Exactly! The following quote comes to mind:
“What sort of personality does one need to have, as a twenty-first-century mechanic, to tolerate the layers of electronic bullshit that get piled on top of machines?”
    ― Matthew B. Crawford

I appreciate technology but when it limits the ability of a vehicle to last as long as its predecessor something is seriously wrong.

I question technology having anything to do with limiting longevity, but I alway say to my neighbor that I would prefer less electronics, especially my pet peeve = electric windows.

Just wanted to update everyone. I'm going to keep the truck and just have the frame replaced. The dealership doing the frame replacement seems like they know what they're doing. With 80k and only $9500 if it lasts me 4 years I'll be okay with it.

Had the frame on my 04 replaced this time last year. Not a dime spent on my side. And they only had the truck 3.5 days. Only thing is I couldn't get my sliders so had to order more.
