    I. Hate. Smokers. (at least the inconsiderate ones)

    Jesus, the guy beside me smokes like ever hour and a half and by noon he just reaks. Gives me a damn headache for the last half of the day and makes my stomach feel blah.

    But he has been here long enough that he was grandfathered into the rule that people will not be hired if they smoke... so he can still smoke.

    But I can't say anything because everyone likes him even though he is lazy as hell... and I would end up being the bad guy of the room.

    Hate inconsiderate smokers, too.

    Reminds me of the time I was at up front at an outdoor concert in Taos. Some college puke was smoking a cigar trying to act cool. Usually when people smoke outside I let it go, but this cheap ass thing *stank* and MsWalla was getting sick to her stomach. We'd worked our way to this spot and were waiting for Big Head Todd to come on so didn't want to move. I asked him to do something about the smoke he was generating. He said something like "I'll just blow it up into the air and it'll be fine." No dice, wasn't working for MsWalla or me. I mentioned to him how smoking a cigar in a crowd of people was a pretty obnoxious thing to do. His response was "Good thing it's a free country."

    Punkass. Telling me it's a free county. Someone hasn't lifted a fucking finger to help create that freedom he's rubbing in my face. I glared at him and said "Then I guess I'm free to stick that thing up your ass."

    He put it out.

    Even though I agree with you whole-heartedly, wouldn't the DOJ have something to say about the rule of not hiring smokers? Just sayin

    That being said, I used to smoke well over 20yrs ago. Stopped, never went back. I too hate the smell of them now and being a lazy one at that, I dunno if I could keep quiet.

    I had a lazy coworker, he thought he was the bomb. He was a friendly one too especially to the lady's. I think he wasted more time doing that then working. Back then, we had a shared cell phone and the bill went through the roof when he had it. I tried not saying anything, but I got so irritated, couldn't keep my mouth shut.
    Yeah, he got fired, he hadn't worked at the company for but three years, where I had well over 10 under my belt.
    I heard he even gotta divorce and from what I understand, went back to school for the education needed to regain employment to do what he wanted. Probably turned out to be the best thing that happened to him even though he probably doesn't know it.

    Moral of the story here is tread lightly. He has more seniority and if mgmt hadn't noticed his lack of productivity by now, then it's on them.

    It is part of the hiring process. They will test for nicotine in your system and if it is there you cannot be hired and cannot have a rehire for 6 months... It has been in place for years.

    I don't know really what to do, we pretty much touch elbows we are so close together without any sort of divider. I mean he will probably end up dieing way sooner than me anyways because of how much he smokes. But why do I suffer in the mean time at my job?

    Don't count on him going anywhere soon. MY BIL has had a heart attack and still smokes.

    I'd think laws would supercede rules, but then again, I don't know what you do or profession is.

    Could you ask to be moved to different Spot? Maybe mgmt would understand Why?

    I think the fact that the healthcare facility that I work for also owns its own insurance company kinda means they don't give a crap about laws...

    When I say there is literally no where to move in this room. There is no where to move. I am stuck here, literally in the middle of three people at a two person desk setup...

    I do need a fan though.

    As an ex-smoker (I vape now), I would suggest (assuming you and he are civil), the following, and allow me to ramble for a minute...

    Yes, some cigarettes smell much worse than others, but the person smoking them seldom realizes just how bad they smell. And quite frankly, every hour and a half is not really that often. That equates to less that a pack a day.

    So... Enough rambling...

    Anyway, just take him aside, and explain that it bothers you somewhat, and ask that if it isn't too much trouble, to stop in the men's room on the way back from smoking, and wash his hands with soap and water. Ask him politely, and in private.

    EDIT... You will be amazed how much of a difference doing that will make.
