    What I love is a lot of people think it is alright to drive during the day with their high beams on. I guess they think that their high beams are not bright during daylight hours.

    Situations like this are a fine line. In his case he probably was breaking some laws for pulling out a gun and pointing it at someone without it really being a defense situation yet. But I am sure if he would have waited about 10 seconds he probably would have been in the right if the guy went really ape shit.

    I don't get the hothead shit where people feel the need to get out and confront another driver, and I ride motorcycles. People have literally nearly killed me and I have never felt like I needed to pull them out of their car over it.

    Well the problem would be him getting out of his vehicle with a deadly weapon aimed at an unarmed individual regardless if the guy was cussing or not. You can't aim guns at people who cuss at you(imagine if you could though o_O) lol

    Also, depending on your local state laws you might be required to flee/run before resorting to deadly force. Regardless of what state he is in, that was absolutely illegal and he could have been arrested. Even if the guy punched him that still doesn't justify the use of deadly force or the threat of deadly force.

    Actually... it depends. I'm in CA, and we know how these folks are... but if you can articulate the fear for your safety, it'd fly. The guy making a u-turn, speeding up to catch him, and then blocking his path? I'd have probably had my gun in my hand as well. Of course I wouldn't have tried to blind the guy in the first place... and when that came out during the interview... yeah, he'd get arrested.

    A vehicle which recklessly passed me and blocked the roadway, at which point the driver began to yell threats and proceed toward my vehicle. Yeah I'd be more than willing to explain to the police, a judge and a jury as to why a firearm was drawn.

    I now see the above conversation. It was at night, I'm unable to see what the driver has in his hands, there was a passenger in the vehicle also yelling from inside and the intersection was after a sharp corner around which I could not see to safely reverse out of the position I was in. As for laws, PA is a stand your ground state and with the articulation mentioned above I have 100% faith that my firearm being drawn was *not* a crime and was completely justifiable. There is no "brandishing" law in PA, so that wouldn't fly either. The driver intentionally waited for an intersection and blocked my path before exiting the far drivers side of the vehicle and proceeding toward mine. Absolutely no way of knowing what this person intended or if he had a weapon. He made it clear that he intended to fight or otherwise place me in danger. "A fear of death or serious bodily injury". Articulation.

    Either way, you'd have a REALLY hard time convincing a jury that you feared for your life enough to pull your weapon and shoot an unarmed man after exiting your vehicle instead of just driving away.

    Your firearm should be a last resort item you use to save your life. Also, participating in road rage will be considered provoking the situation in the first place.

    Seriously? Take some classes before you get yourself a lengthy prison sentence. Yes, what you did was illegal.

    Now you say he "yelled threats".

    Your vehicle has a reverse gear, correct? Door locks and windows?

    Do yourself a favor and take some CCW classes. You're not as justified as you think.

    I suppose it's a good thing a finger never even made it into the trigger guard then.

    Would you wait until you positively identify a deadly weapon in the hands of someone walking around the side of a car at night less than 12 feet from you?

    You'd be dead before you could unholster.

    The law has nothing to do with where your finger is. The act of upholstering a deadly weapon and aiming it at someone is where the law comes in. Your life was not in danger and you'd have no way of proving it was. If you really thought your life was in danger you wouldn't have opened the door to get closer to the situation and put yourself into more "danger".

    Also, brandishing a firearm isn't a crime in PA?!? o_O

    You're right. There is no point in continuing this back and forth with you. I've explained clearly how what I did was justified. My initial post obviously lacked all the small details and you latched onto it. I since gave more of those details after the post gained more attention and you seem to have not read it.
