Can somebody set me straight on transfer laws?

    So long story short my parents have had a safe deposit box in Iowa for over 35 years with a WWII luger in it from my grandfather who died a long time ago. We have all been in AZ for 30+ years. The bank is closing and is going to send the pistol to one of my parents via local FFL. Neither of them are gun people and are hesitant to go pick it up. I am a into guns and will likely end up with it.

    I assume for me to pick it up via 4473 form it needs to be shipped to me? I know it's best to ask the FFL directly, but id like to get my facts semi-straight first.

    Have it shipped to a local FFL (gun store) with your name as the 'to', fill out the purchase form and boom, its yours.

    Your correct. The sender will have to ship it to an FFL in your state in your name (ensure it is your full legal name). The sender will need to use FedEx or UPS and since it's a handgun it must go next day. Once it comes in, swing by, do a 4473 and your good to go. Some shops charge a $5- $25 fee to transfer but if your a regular or know the place well they will likely do it for free.

    If they WON'T send it to you and will only send it in your dad's name then you will have to drag him along to fill out the 4473. Then he can simply turn around and give it to you.

    That's what I figured and the most likely outcome. I am not listed on the safe deposit box, so it's doubtful they'll send it in my name.

    A firearms expert I know uses Ezox to inhibit rust...but I think you've gotta apply before it rusts. Penetrating oil can do wonders on rust if it's bad.

    Keep us posted on this and let us know how the gun looks. You might be surprised how good (or bad) of shape it's in. That's a real piece of history you've got regardless of condition. WWII stuff is the most interesting type of collectibles out there, at least that's what I think.

    If your dad is totally against the firearm for some odd reason and refuses to sign for it your only other option is to get a living specific power of attorney pertaining to the safety deposit box. Most small law firms will do them for pretty cheap and it will suffice for the bank to send it to you. I wouldn't be worried about the condition of the firearm. Most bank vaults have a dehumidifier and I'd imagine it's still in good shape. If your keeping it as an heirloom I would be very careful cleaning it. I worked at a firearms manufacturer and we used bags by ZCORR to prevent rust on un treated/coated barrels while in storage. They work great.

    In addition to 4473 federal form, you have to be eligible to buy a pistol in your state. Means likely you either need a hand gun purchase permit or concealed carry permit issued by your local municipality or more likely sheriffs department, so the ffl will allow you to fill out the 4473.

    The 4473 is the federal record requirement still need handgun permit.

    He's in Arizona, as long as he is 21 and not a felon he will be good to go.

    NC is the only state I know of (very likely others) that does this. You have to have a permit before even buying. Here, a permit to carry is optional. 21 yrs old, no felony, no problem.

    Not necessarily permission, but kinda. Illinois law abiding residents must have a F.O.I.D. (think that's the acronym) card to purchase ammo. Cook county and the Chicago area have the strictest of guns laws, with among the most gun crime in the country. Go figure...
