    It's a bradford pear tree - not worth doing anything to it. Will just split elsewhere. They are pretty trees, but super weak and split all the time. But thanks for the tip

    Perhaps remind him / her gently that his insurance will be paying for the damage done to your property . Perhaps if that conversation doesn't go well or you do not want to have it . Talk to your own insurance company see if they will do a "Home Inspection" and have them go over and explain it to him / her. Though your policy and state laws may say what ever damage is yours to fix if his tree falls on your fence. However, most states I have lived in if his tree falls over and damages your property it is his home owners that pays.

    I wouldn't I would just take the picture and another showing how far from you fence / property line. If you opt to have it taken down and anything happens on his side bet he will come after your home owners insurance. I am not an expert at all but I bet you will have to have something on paper from him to have a tree company do anything with it since it is on his property not yours.
