Hey guys, my name is Derek and this is my first post but I'm glad to say that Tacoma world has provided me with a bunch of helpful info, but I cant seem to find much info on my current situation. Bare with me its kinda a long story ill make short.

    • Ok I bought an 05 Tacoma double cab pre-runner in late DEC. 09 with about 80,000 miles on it for 14,800 with coil spacers and brand new 32' BFG mud terrain tires with the sport hood scoop and painted everything.
    • I have been trying to keep it looking its best and one day recently as i was detailing the inside i decided to take the a pillar garnishes off to get in between the cracks.
    • I remove the pieces and to my surprise I notice that the entire roof from a silver Tacoma has been welded on from half way up the A-pillar and at the tops of the back and side pillars.
    • the guys at the car lot had said that the truck had never been in an accident ( which it clearly had)
    • the car-fax shows no record of an accident ever.
    • it was auctioned off in September 08 and then I'm guessing the lot bought it after one year it had 80,000 miles
    • now I'm stuck with a taco that looks like its been rolled and I don't know if its going to be safe. I work at a Honda parts department and we own a body shop. I'm going to meet up with one of the tech's there and see if the repairs are done right or if the truck is safe at all.
    • I guess I'm asking what you think of the situation and what i could do about it if it does turn out not to be safe. i love the Tacoma's, i think they are one of the best trucks out but i don't want to be stuck rolling around in one that may not be structurally sound. thanks for any input you guys
P.S. what about that for a first post haha, and ill also get some pics tomorrow in the daylight b/c its really hard to imagine what it looks like.

Can you get them for fraud and not informing you of a prior accident?

If I were you. Get all your paper work in order. Start taking pictures of all the claims. When you first found out about it and how. Then you should have it inspected professionally and get everything documented.

Once you've got all the evidence that the vehicle was well misrepresented to you upon sale. You can present it to the Dealer you bought the vehicle from.

I suspect from there, its up to the Dealership to proceed with resolving the situation. However if they deny the accident. You'll need to seek the help of a Lawyer.

Good Luck as thats not very reassuring at all.

I just Re_Read your post. I take it your TACO is not Silver and the roof top has been. The Taco suffered Roof damage for sure and it was repaired under the books. You'd be surprise how many vehicles go unreported from accidents.

Is the dealer a Trusted one?

I have the furtune to know some of the people at our collision center who are really well know around my area but i will have them look at it for sure and place all my documentation in order.

I'm not surprised this type of stuff happens, i mean i work at a dealership that has a used car/new car/service department and we hear some killer stories but man, did i not see this coming lol.

I do also have a really close friend like a brother to me, has a family member who is a lawyer. woot woot ! hook up lol.

    • Another question is with my loan. if any of ya know about that. I put 2 rand down, will i see that money or is it already sunk?

wow man thats messed up. i dont think you should worry about getting your money back because that right there is FRAUD. even if the dealership didnt know it was in an accident, they still should have looked over the vehicle pretty throughly. get a lawyer and raise hell!

    No

And Carfax is a joke - they only can do so much, not uncommon for an accident not to be logged by them

Pretty much gone, unless you asked "was this vehicle ever damaged" and they answered with a falsehood ---

you will never prove a false statement unless the seller was incredible stupid

If the accident was a simple roll over while 4 wheeling the vehicle should be relitivly safe.

This is why I do not buy a used 4x4 EVER

Welcome to TW Derek and I am very sorry for your troubles. You have a very good case against the dealer as Cali laws are very clear about this kind of thing. Take it to the dealer and if they don't take it back then go straight to a lawyer. I used to work in this dirty business and stuff like this is why I got out. If your loan is against the title than the bank would be very interested also. Good luck man

^This- I would get the guys where you work to give you some opinions but (see below)

The guy could have done the work himself or paid a friend to do it and it may never have been reported to carfax....so it's entirely possible that the dealership who bought the truck from auction doesn't know that it was wrecked either.

It's not fraud if they didn't know.

Is it a Toyota dealership or is it some random hole in the wall place? I'd document everything and then go ask to speak with one of the managers and go from there. If that doesn't work I'd start going up the chain at Toyota first before filing any lawsuits. You could also threaten to take it to the local news and that might get them willing to assist you.

I remember seeing another thread here about another member who had bought a truck that had a leaking roof and had discovered that it had been repaired. Search around and see if you can find that one. I think the dealership ended up buying his truck back.

OP needs to provide more info as many assumptions are being made here.

Perhaps the vehicle wasn't rolled. The roof could have been damaged another way, i.e., tree damage, or other big dent that required roof replacement. Also, I wouldn't assume that the dealer could be held responsible if the info wasn't reported to them - OP said that Carfax didn't show it. Was it a random used car lot or a reputable dealer?

Yes Carfax is a joke. It's been reported that it's accurate less than 40 percent of the time. It's almost 100 percent accurate if a vehicle has been declared salvaged.

The reason it isn't accurate (aside from any problems they have themselves) is that only the major insurance companies report the accidents for carfax to pick them up. Most of your smaller insurance companies don't report them, thus they never show up.

What's even worse is when you try to sell your vehicle that's never been in an accident and no one will buy it because the inaccurate carfax report shows that it's been in a major wreck.

Carfax = Garbage in and Garbage out

Yeah i hear ya on the carfax stuff. but im at work today and i appreciate all your guys input. ill be taking photos around 4-5 pm. next week i will actually be taking it the the bodyshop and then go from there. if all is good. i plan to keep it and pimp it put.

the body shop actually replaced my parents roof the same way so i know they have experiance. the insurance company covered everythig. so im optomistic that it could be ok but we'll see
