    Who is to say that they were going to drive? And not get a coat or something? I say, watch. If that person attempts to drive, then nab them. But to say that I am going to drive and not actually see me do it is wrong. Innocent until proven guilty. I have, many times, been in a bar that I have driven to sober with my wife. Gotten drunk and gone out to get something out of the truck. My wife, who is inside and not seen usually has ZERO drinks if I am the one drinking is driving home. You mean to tell me I am a risk? Whoever came up with that law should be tarred and feathered.

    Actually the officer CAN NOT watch someone he believes to be intoxicated get behind the wheel and drive. They are required (at least here) to stop the suspect prior to entering the vehicle. At that point it is really just public intoxication usually followed by disorderly conduct or failure to obey. I'm sorry fellas, IMHO if you even intend to drive after drinking (I dont' care how much) you need an ass whoopin and a night in jail. Period. I can't tell you how many body parts I scraped off the roads after some dumb ass thought, "Well, I've only a couple". Fk that!!! Oh, also, if you allow someone to drive your vehicle drunk, you can be charged with Permitting DUI.

    I know in washington its actually called an Operator In Control and your keys have to be in your possession and you have to be inside the car. but also unless they recently changed the law you also have to be on a public road. I have heard about the lawnmower story before but i'm not really buying that if your mowing your yard they can give you a D.U.I. i may be wrong tho.

    just from emt classes, im thinking the cops thought he was a diabetic. diabetics have a lot of the same symptoms as drunks when their sugar is too low.

    That is true. Diabetics who are about to go into shock will show the same symptoms including an alcohol smell from their breath.

    If your friend isnt in jail yet then hes good. There is no chain of custody for the blood that they took if they were gonna lock him up it would have been right there. Your friend could argue that the blood wasnt even his. DUI is normally taken very and there are steps that have to be followed or the person get off. I allso dont think you would be able to get a judge to sign off to obtain blood results that were not taken for that pupose HIPPA the patients bill of rights would not allow it.

    Oh, you are so sadly mistaken. I have arrested a number of people on sample taken while no officer was present. The hospital personnel would be required during trial but most of them are experienced in these scenarios.

    I forgot to add that at least in SC, walk away with a slap on the hand. No real punishment for drunk driving.

    Too a point. I have a ''friend'' that barely got out of a Operator In Control because he figured he was to drunk to drive and took a little nap in his car trying to sleep it off and woke up on his way to jail.

    I agree with everything you guys are saying and I had a long talk with him earlier. He has given up on trying that crap, maybe it scared him enough to no do it again. Arizona has some of the harshest DUI laws and I'm leaning towards he is going to get caught for this. I used to work at department of transportation and also have had to clean up drunk driver accidents and actually see the bodies and parts lying there. It could have been a lot worse, I just wanted your guys opinions but I thank each one of you and I showed this thread to my buddy so he could see for himself that he has no one but himself to blame.

    :smack:Whether or not your "friend" gets busted, he made a really stupid choice and hopefully learns his lesson. Honestly, I hope he does get busted.

    Driving after a drink or two, while still illegal, is one thing. This dumbass couldn't even stay awake at the drive thru. He could just as easily have passed out while driving and killed a woman and her children. His biggest concern is whether or not he gets a DUI? Fucking idiot.
